JAKARTA, PUBLIC RELATIONS OF THE CONSTITUTIONAL COURT—On Tuesday (16/02), Constitutional Court read out the Decision Number 91/PHP.BUP-XIX/2021 concerning the case filed by Candidate Pair Number for Regent and Vice Regent of East Kutai Mahyunadi and Lulu Kinsu declaring that the case was unacceptable.
In the legal consideration read by Justice Saldi Isra, the Court explained that votes difference between the petitioner and the candidate pair with the most votes was 16.747 votes (11,01%) exceeding the requirements in the Article 158 Paragraph (2) Letter a of the Law Number 10/2016. In order to pass this requirement, petitioner claimed on an alleged administrative violation—improper publishment of electronic ID Cards (e-KTP).
Evident provided by the petitioner to support the claim had been examined by the Court in the hearing to which the Court responded that publishing e-KTP was the authority of Service of Population and Civil Registration (Disdukcapil). Petitioner had also received an explanation from the said institution that there were no indications that voters had published multiple e-KTPs. If a person recorded an e-KTP more than one time, then the second and next e-KTP could not be published. Sub-district election supervisory committee (Panwascam) also revealed that based on their observation there was no correlation between alleged multiple e-KTPs and the votes.
“Court opined that Petitioner in reconstructing this matter could not convince the Court that in the said districts there were correlation esulting in the votes,” said Justice Saldi Isra.
On other claims, he said that those claims did not affect the elected candidate hence the Court did not consider. Hence, the Court was not convinced to sheer off the requirements in the Article 158 Paragraph (2) Letter a of the Law Number 10/2016 to proceed the case further.
In the preliminary hearing, Petitioner claimed an alleged violation in East Kutai such as multiple e-KTP around the voting day and vote counting period (June-December 2020). It was done in a structured, systematic, and massive manner as much as 20.262 in East Kutai Regency.
Violation was also worsened by the replacement of the Head of Disdukcapil of East Kutai Regency by Kasmidi Bulang as the Acting Regency of East Kutai or incumbent, as well as the abuse of power in the Indonesian Social Card/Kartu Indonesia Sehat (KIS) program during the election process.
