JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) held the ruling hearing of the 2020 Regional Election Results Dispute, Monday (15/2/2021), in the plenary courtroom. A total of 33 decisions were read out in the morning-evening session which divided into three online sessions. The first session was held at 09.00 WIB to read out 14 decisions. Then, the second session, at 13.00 WIB,  the court read out 8 decisions. While, the third session, at 16.00 WIB  the court read out 11 decisions.

In the third session, the Constitutional Court declared the 2020 South Lampung Regent Election Results Dispute case No. 47/PHP.BUP-XIX/2021 is unacceptable. In the legal considerations read out by Constitutional Justice Aswanto, it was stated that the Petitioner has no legal standing to file a quo case in accordance with Article 158 (2) of Law 10/2016.

"The number of differences in the vote results between the Petitioner and the election winner was 0.5% x442,561 votes. Thus, the maximum difference for being able to submit a petition to the Constitutional Court is 2,213 votes. Meanwhile, the Petitioners' votes were 136,459 votes, and the Relevant Party were 159,987 votes, hence the difference in the votes acquired was 23,528 votes, thus more than 2,213 votes. Based on these considerations, the Petitioner does not have the legal standing to file a quo case in accordance with Article 158 (2) of Law 10/2016," said Aswanto.

It should be noted that the a quo case filed by Candidate pair No. 3 Hipni-Melin requested the annulment of South Lampung KPU Decree No. 75/HK.03.1-Kpt/1801/KPU-Kab/Xn/2020 concerning the certification of vote count results recapitulation on December 16, 2020, at 03.22 WIB, the petitioner also asked the Court to order KPU to conduct a Re-Voting (PSU).
