JAKARTA, Public Relations of the Constitutional Court— The Constitutional Court (MK) held the ruling hearing over Pandeglang Regent Election Results Dispute on Monday (15/2/2021). In the hearing session presided by the Chief Justice of the Constitutional Court Anwar Usman accompanied by eight other Constitutional Justices, the Court stated that case No. 74/PHP.BUP-XIX/2021 was unacceptable. "In the principal of the Petition, declare the Petitioner’s petition cannot be accepted," said Anwar in the Plenary Court Room.

In its legal considerations, the Court declared that the petition filed to the Registrar's Office on Saturday, December 19, 2020 at 00.33 WIB. Meanwhile the Respondent (KPU) announced the certification on Tuesday, December 15, 2020 at 22.29 WIB.

“The deadline of three working days from the time Respondent announced the certification of vote count results was Tuesday, December 15-17, 2020, at 24.00 WIB. Hence, the Petition was over the deadline according to the law and regulation," said Wahiduddin Adams.

At the preliminary hearing on January 29, 2021, Thoni Fathoni - Miftahul Tamamy argued that there was a violation of State Civil Apparatus (ASN) neutrality committed by Cimanggu District Head which the report’ result and recommendation status were unclear and not legally binding. The Petitioner said that up until now, they had been unable to access official information from Election Supervisory Body (Bawaslu) website and could not made online complaints. Thus, the Petitioner suspected that Bawaslu was not carrying out its duties and functions properly and correctly.

In their petitum, the Petitioner asked the Court to order KPU to carry out a re-voting (PSU) in 35 sub-districts throughout Pandeglang Regency or PSU in sub-districts based on the available violation evidence during the campaign process of the 2020 Pandeglang Regent Election *)
