JAKARTA, Public Relations of the Constitutional Court—The 2020 East Halmahera Regency election results dispute petition by Candidate Pair No. 1 Thaib Djalaluddin-Noverius Bulango was struck out. The Decision No. 26/PHP.BUP-XIX/2021 was read out by Chief Justice Anwar Usman alongside the eight constitutional justices on Monday, February 15, 2021. “[The Court] declares the Petitioner’s petition inadmissible,” said Justice Anwar reading out the verdict in the plenary courtroom.

In the legal considerations read out by Constitutional Justice Wahiduddin Adams, the Court stated that the petition had passed the deadline as stipulated by the legislation.

“The deadline to file a dispute petition was three days since the Respondent announced the certification of the election results—December 15-17, 2020 at 24:00 WIB. Meanwhile, the Petitioner’s petition was submitted to the Registrar’s Office on Friday, December 18, 2020 at 15:52 WIB based on the petition filing certificate (APPP) No. 27/PAN.MK/AP3/12/2020. Based on these facts, the Court deems the Respondent’s and the Relevant Party’s objections regarding the deadline is legally grounded,” Justice Wahiduddin explained.

At the preliminary hearing, Candidate Pair No. 1 Thaib Djalaluddin-Noverius Bulango filed the case No. 26/PHP.BUP-XIX/2021. They alleged that Candidate Pair No. 2 Ubaid Yakub-Anjas Taher (Relevant Party) had committed massive vote buying or “money politics” in ten subdistricts, which had been reported to the regency panwas (election supervisory committee). They also allegedly mobilized ASN (state civil apparatus) and printed electronic KTPs (resident ID cards) three days before voting day. The Petitioner also alleged a violation regarding the dismissal letter of regent candidate No. 2 Ubaid Yakub, which wasn’t included in the application.
