JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) declared the petition by Purworejo Regency Candidate Pair No. 2 Kuswanto-Kusnomo inadmissible. The Decision No. 29/PHP.BUP-XIX/2021 was read out by Chief Justice Anwar Usman at a ruling hearing on Monday, February 15, 2021 in the plenary courtroom. 

In the legal considerations read out by Constitutional Justice Enny Nurbaningsih, the Court stated that the vote counting results of the Purworejo regent election was certified by the regency’s General Elections Commission (KPU) on December 15, 2020 at 17:24 WIB. It was announced on the regency KPU’s announcement board and website. The deadline to file a dispute petition was three days since the certification was announced—Thursday, December 17, 2020 at 24:00 WIB.

“However, the Petitioner filed their petition on Friday, December 18, 2020 at 15:33 WIB, so the petition was past the petition deadline as set in the legislation,” Justice Enny said before the parties who attended the hearing remotely.

At the preliminary hearing on January 26, 2021, Candidate Pair Kuswanto-Kusnomo expressed their objection to the Purworejo Regency KPU decree No. 692/PL.02.6-Kpt/3360/Kab/XII/2020 on the certification of vote counting recapitulation of the 2020 Purworejo Regency election dated December 15, 2020, which declared incumbent Agus Bastian-Yuli Hastuti (Candidate Pair No. 3) as victors.

The vote margin between the Petitioner and the incumbent was allegedly due to structured, systematic, and massive (TSM) violations. Among them is the alleged forgery of signatures by polling station working committee (KPPS) members of Bener, Purworejo, Bayan, and Gebang Sub-districts. There was also discrepancy between the attendance list, the number of signatures, and the number of votes. 

The Petitioner also alleged that the Relevant Party (Agus Bastian-Yuli Hastuti) also abused their power because as incumbent they had distributed hundred thousands of calendars at a total of Rp2.4 billion to the local community.
