JAKARTA, PUBLIC RELATIONS OF THE CONSTITUTIONAL COURT – On Monday (15/02),  Constitutional Court held the ruling hearing in the Court plenary room stating that the case Number 65/PHP.BUP-XIX/2021 2020 Regional Head Election Results Dispute concerning Sijunjung Regent could not be accepted.

“Declaring that the petition could not be accepted,” said Chief Justice Anwar Usman accompanied by other Justices.

Court decided that the petition had passed the deadline based on the Article 157 Paragraph (5) of the Law 10/2016 as well as the Article 1 Number 31, Article 7 Paragraph (2), and Article 9 Paragraph (7) of the Constitutional Court Regulation Number 6 Year 2020 concerning the Court Procedure of Regional Head Election Results Dispute (PMK 6/2020).

“Deadline was 3 (three) days after the Respondent declared the voting results which was 15-17 December 2020 at 24.00 WIB while the petition was filed to the Registry of the Court on Friday, 18 December 2020 at 23.20 WIB. Therefore, the Respondent and Relevant Party exceptions concerning the deadline were in accordance with the law whereas other exceptions and petitioner pleading as well as other matters were not considered by the Court,” explained Justice Wahiduddin Adams.

In the case Number 65/PHP.BUP-XIX/2021 filed by Candidate Pair Number 5 for Sijunjung Regent, Hendri Susanto – Indra Gunalan, petitioner stated that the case was not related to the voting results but to other matter which was the late submission of a report concerning the in and out campaign budget or Laporan Penerimaan dan Pengeluaran Dana Kampanye (LPPDK) instead. 

Petitioner claimed the alleged violations done by Regent Yuswin Arifin, father of the Candidate Pair Number 3, which included Civil Servant(s) in the regency who were supposed to be neutral. The violation started when Benny Dwifa Yusfir (Candidate Pair Number 3) who was still a Civil Servant (Head of Badan Perencanaan Pembangunan Daerah or Bappeda of Sijunjung Regency) applied for his candidacy.
