JAKARTA, PUBLIC RELATIONS OF THE CONSTITUTIONAL COURT—On Monday afternoon (15/02), the Court read out the Decision Number 41/PHP.KOT-XIX/2021 concerning 2020 Regional Head Elections Result Dispute for Mayor of Medan which was declared nullified.

 “Deciding, declaring the case was nullified,” said the Chief Justice Anwar Usman accompanied by other Justices.

Previously, the Court had received the petition dated on December 18, 2020 filed by Candidate Pair Number 1 Akhyar Nasution and Salman Alfarisi with the power of attorney given to Juneddi TM Tampubolon et al. The Court received and recorded the petition on the e-BRPK)on the same day Numbered 41/PHP.KOT-XIX/2021. 

Concerning the a quo case, Court had published the Decree of the Chief Justice regarding the Formation of the Justices Panel to examine the case and followed up by the preliminary hearing on January 27, 2021 in which neither petitioner nor the attorney was present without valid reason despite being summoned in accordance with the law.

Based on the Article 37 Paragraph (2) of the Constitutional Court Regulation (PMK) Number 6 Year 2020 concerning the Court Procedure for the Regional Head Elections Results Dispute which stated, ““In the case of Petitioner or attorney as mentioned in the paragraph (1) do not come to the preliminary hearing without valid reason although has been summoned in the valid and correct way then the petition shall be nullified.”

Through the Justices deliberation meeting on February 10, 2021 decided that the withdrawal was legally grounded. The meeting also ordered the Chief Registrar to recorded the petition in e-BRPK.
