JAKARTA, PUBLIC RELATIONS OF THE CONSTITUTIONAL COURT—Constitutional Court accepted the withdrawal of the petition filed by Candidate Pair Number 2 Suyatno and Jamiludin concerning the 2020 Regent Election Results Dispute of Rokan Hilir Regency.

“The Court grants the withdrawal of case Number 85/PHP.BUP-XIX/2021 concerning the 2020 Regent and Vice Regent Election Results Dispute of Rokan Hilir Regency,” said the Chief Justice Anwar Usman accompanied by other Justices.

In the ruling, Court revealed to have received the petition dated on December 19, 2020 filed by Suyatno and Jamiludin as Candidate Pair Number 2 of Regent and Vice Regent of Rokan Hilir based on the power of attorney given to Asep et al submitted to the Registry of the Court on December 20, 2020 as registered on the Buku Registrasi Perkara Konstitusi (e-BRPK). On January 29, 2021, Court had conducted the preliminary hearing with the agenda of examining the files and petition, validation of the evident, and confirmation of the Relevant Party.

Court then received the withdrawal letter for case Number 85/PHP.BUP-XIX/2021 signed by the principal and submitted by the attorney on February 4, 2021 in the follow-up hearing with the agenda of hearing the Respondent Answer and information form the Relevant Party and Elections Supervisory Body (Bawaslu).

Concerning the withdrawal, Article 20 Paragraph (1) PMK Number 6/2020 stated that, “Petitioner could request a withdrawal through written information before the Court ruled on the case.” Justices in their meeting on February 10, 2021 decided the withdrawal was in accordance with the law and petitioner could not submit the a quo case later in the future. This matter was recorded in the Buku Registrasi Perkara Konstitusi Elektronik (e-BRPK) by the Registrar.
