JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) granted the petition withdrawal request by Sigi Regency Candidate Pair No. 2 Husen Habibu-Paulina. The Decree No. 112/PHP.BUP-XIX/2021 was read out by Chief Justice Anwar Usman alongside the other eight constitutional justices on Monday, February 15, 2021 in the plenary courtroom. 

Justice Anwar stated that at the preliminary hearing on Thursday, January 28, 2021 the Petitioner through attorney Moh. Amin Khoironi had verbally requested to withdraw the petition and submitted a written request. The Court’s decree barred the Petitioner from re-filing the case.

At the preliminary hearing, the Petitioner requested that the Court annul the Sigi Regency KPU (General Elections Commission) Decree No. 450/PL.02.6.Kpt/7210/KPU-Kab/XII/2020 on the certification of the 2020 Sigi Regency election vote counting recapitulation dated December 17, 2020. They alleged that the Sigi regent election was full of structured, systematic, and massive (TSM) manipulation and violations in the certification of candidates, the provision and distribution of logistics, the campaign period, as well as the voting and vote counting stages.

The Sigi Regency KPU was accused of not being neutral by withholding the C6 forms from eligible voters in several subdistrict, villages, and polling stations (TPS) who supported the Petitioner, especially in Palolo, Marawola, Konovaro, Sigi Biro Maro, Tananbulava, Gumbasa, and Lindu Subdistricts. Such an act, the Petitioner said, had harmed them in the election.
