JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) declared the 2020 East Halmahera Regency election results dispute petition No. 30/PHP.BUP-XIX/2021 inadmissible. The ruling hearing for the petition filed by Candidate Pair No. 3 Moh. Abdu Nasar-Azis Ajarat took place on Monday, February 15, 2021. “[The Court] declares the Petitioner’s petition inadmissible,” said Chief Justice Anwar Usman reading out the verdict alongside the other eight constitutional justices.

In the legal considerations read out by Constitutional Justice Wahiduddin Adams, the Court stated that the petition had passed the deadline as stipulated by the legislation.

“The deadline [to file a dispute petition] was three days since the Respondent announced the certification of the election results—December 15-17, 2020 at 24:00 WIB, so there was no difference in day and date of the certification of the 2020 East Halmahera regent election results and its announcement. Meanwhile, the Petitioner’s petition was submitted to the Registrar’s Office on Friday, December 18, 2020 at 15:43 WIB based on the petition filing certificate (APPP) No. 27/PAN.MK/AP3/12/2020. Based on these facts, the Court deems the Respondent’s and the Relevant Party’s objections regarding the deadline is legally grounded,” Justice Wahiduddin explained.

At the preliminary hearing, Candidate Pair No. 3 Moh. Abdu Nasar-Azis Ajarat requested for case No. 30/PHP.BUP-XIX/2021 that the East Halmahera Regency KPU Decree No. 107/HK.03/1-Kpt/8206/KPU-Kab/XII/2020 on the certification of the 2020 East Halmahera Regency election vote counting recapitulation dated December 15, 2020 be annulled. In addition, they requested that the Court order the East Halmahera KPU to hold a revote (PSU) at several polling stations in East Halmahera.
