JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) has completed the early proceedings for the 2020 regional head election results dispute settlement. The constitutional justices then discussed the cases in a deliberation meeting (RPH), where each panel of justices presented the results of their case examination, said Chief Registrar Muhidin in an interview with the Court’s media crew on Friday, February 12, 2021 at the Constitutional Court.
“The results [of the case examination] is reported by each panel at a closed plenary [justice deliberation meeting]. [The meeting] is in session right now,” he explained. All nine constitutional justices attended the meeting.
Muhidin further explained that at the preliminary hearing, the Court had examined the petitions. The petitioners explained their petitions with regards to their legal standing, the petition deadline, and the arguments. The Court had also held second hearings to hear the respondent’s response as well as statements by the relevant party and the Elections Supervisory Body (Bawaslu). “Those agendas have been completed by Tuesday, February 9, 2021,” Muhidin said.
Ruling Hearings
Muhidin said that the next stage would be ruling hearings, scheduled for February 15-17, for the cases whose examination have been completed. The Court announced this on its website and has summoned the parties for the hearings. “It should be noted that the ruling hearings will be different from previous hearings because they will be online. Not one party will be present [at the Court]. They will be present virtually,” Muhidin explained.
Evidentiary Hearings
Muhidin explained that the cases that go forward will undergo evidentiary hearings. At this stage, the parties may add evidence, both in writing and by presenting witnesses and experts. The witnesses and experts will testify virtually. “Therefore, the parties are expected to submit a list of witnesses and experts no later than one day before the hearing,” he said.
Before concluding the interview, he stressed that after the Court completes all evidentiary hearings, it will examine all cases in private. By the end of March 2021, the Court will make decisions regarding those regional head election cases.
