JAKARTA, Public Relations of the Constitutional Court—The hearing session of the 2020 Jambi Governor Election Result Dispute was held by the Constitutional Court (MK) on Monday (1/2/2021) for Panel II. The hearing agenda was listening to the Respondent's answer, Elections Supervisory Body’ (Bawaslu) statement, and the statement of the Related Party. The Panel II session was presided by the Deputy Chief Justice of the Constitutional Court Aswanto, alongside Constitutional Justices Suhartoyo and Daniel Yusmic P. Foekh.

Jambi General Elections Commission (KPU) as the Respondent represented by their team of attorneys firmly rejected the argument of Candidate Pair No.1 Cek Endra and Ratu Munawaroh, as Petitioner for case No.  130/PHP.GUB-XIX/2021. In the previous hearing, they argued that the entire 2020 Jambi regional head election (Pilkada) was marked by a lot of violations and fraud.

"This argument is very unfounded and conjectural. The whole community witnessed the election process. Furthermore, Bawaslu has never provided recommendations to the Respondent regarding the election violations argued by the Petitioners," explained Muhammad Syahlan Samosir, attorney of Jambi Province KPU.

Meanwhile, based on the supervision of Jambi Bawaslu on the certification of vote count result recapitulation by Jambi KPU, no violations were found. The vote results of Candidate Pair No. 1 Cek Endra and Ratu Munawaroh were 585,203 votes, Candidate Pair No. 2 Fachrori Umar and Syafril Nursal won 385,388 votes, Candidate Pair No. 3 Al Haris and Abdullah Sani received 596,621 votes. Even though there were objections from all candidate pairs participating in the elections, Bawaslu has delivered a number of improvements and have been followed up.

Furthermore, the Relevant Party through his attorney Heru Widodo stated that the violations which were used as arguments and the basis for the application in the matter of cancellation of Pilkada results have been resolved by law enforcement in the Provincial Bawaslu. Thus, said Heru, law enforcement on the problems in a quo petition has been completed entirely. Therefore, it is reasonable for the Relevant Party to apply to MK in order to consent the Petitioner's petition unacceptable.

In addition, the Relevant Party respond the statement which said that the Petitioner is the most voted candidate based on the data from independent surveys. This, according to the Related Parties, cannot be the basis for claiming fraudulent elections.

"Based on the official calculation of the Respondent, the Petitioner is in the second position. While the Related Party is in the first position," explained Heru.

Sungai Penuh Mayor Election Result Dispute

Sungai Penuh KPU through the legal authority of MS Alfarisi evaluated the object of petition case No. 67/PHP.KOT-XIX/2021 filed by Candidate Pair No. 2 Fikar Azami and Yos Adrino, which was not the object of regional head election dispute. It is the certification of Sungai Penuh KPU concerning the votes acquisition as a result of the election, so that it cannot be the object of dispute.

Furthermore, Sungai Penuh Bawaslu has fully supervised all the processes of the election from beginning to end. Bawaslu did not find the violations committed by the Related Party as the winner in the election. The Relevant Party asserted, that the petition to annul KPU certification was a mistake and not the authority of the Court.
