JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) held three preliminary hearings of the 2020 regional head election results dispute (PHP Kada 2020). First, South Bandar Lampung Mayor Election Result Dispute petition case No. 25/PHP.KOT-XIX/2021 filed by Candidate Pair No. 2 Muhammad Yusuf Kohar and Tulus Purnomo Wibowo. Then, there were two South Bandar Lampung Regent Election Result Dispute with petition case No. 47/PHP.BUP-XIX/2021 filed by Candidate Pair No. 3 Hipni and Melin Haryani Wijaya, and No. 61/PHP.BUP-XIX/2021 filed by Tony Eka Candra dan Antoni Imam (Candidate Pair No. 2).
The Panel session led by Deputy Chief Justice of the Constitutional Court (MK) Aswanto, accompanied by Constitutional Justices Suhartoyo and Daniel Yusmic P. Foekh. Aswanto opened the hearing session and was followed by the introduction of the parties who were present online and offline. Then, before beginning the examination stage, Suhartoyo asked about the withdrawal of Muhammad Yusuf Kohar and Tulus Purnomo Wibowo.
"There was a withdrawal of the petition for case No. 25 on January 8, 2021. We would like to ask the truth about it. Was this withdrawal actually carried out?" asked Suhartoyo.
The Petitioners' attorney confirmed the withdrawal of the petition. Ahmad Handoko stated that the withdrawal of the petition was at the Petitioner's request.
“Yes, Your Excellency. Our principal asked to withdraw the petition," said Ahmad.
Alleged the Fraud of South Lampung General Elections Commission (KPU)
At the same session, the panel held preliminary session of South Lampung Regent Election Dispute which filed by Candidate Pair No. 3 Hipni and Melin Haryani Wijaya. Yopi Hendro as the Petitioner's attorney stated that the recapitulation vote count results which certified by South Lampung KPU showed that Candidate Pair No. 1 Nanang Ermanto and Pandu Kusuma Dewangsa won 159,987 votes. While Candidate Pair No. 2 Tony Eka Candra and Antoni Imam received 146,115 votes. Meanwhile, Candidate Pair no. 3 (Petitioner) received 136,459 votes.
Furthermore, the panel of judges held the inaugural session of PHP for the Regent of South Lampung for 2020, which was proposed by Candidate Candidate Number 3 Hipni and Melin Haryani Wijaya. Yopi Hendro as the pair's attorney stated that the results of the recapitulation of the vote count determined by the South Lampung KPU showed that Candidate Candidate Number 1 Nanang Ermanto and Pandu Kusuma Dewangsa won 159,987 votes. Then Candidate Candidate Number 2 Tony Eka Candra and Antoni Imam received 146,115 votes. Meanwhile, Candidate Candidate Number 3 (Petitioner) received 136,459 votes.
The Petitioner believed, there had been fraud by the Respondent which affected the vote result, in this case South Lampung KPU. Members of Polling Station (TPS) 19, Polling Station Working Committee (KPPS) in Candimas Village and Natar Subdistrict, have conducted a pre-election campaign to win Candidate No. 1,” explained Yopi Hendro.
Hereinafter, the Petitioner argued that the violations included not distributing the C-6 form as an invitation to voters. In addition, there is the involvement of local State Civil Apparatus (ASN) officials. Based on all the findings, the Petitioner through their legal team asked MK to annul the decision of South Lampung KPU and order the Respondent to re-vote.
At the same session, Tony Eka Candra dan Antoni Imam argued that there had been a violation of South Lampung Regent Election as only about 64.99% of DPT using their rights. This argument, according to the Petitioner as a deliberate act,and as per the finding of Elections Supervisory Body (Bawaslu) that KPU in distributing the C-6 form, there were 31,964 sheets did not reach to the voters as per final voters list (DPT). With these indications and the difference in votes between Candidate Pair No. 1 and Candidate Pair No. 2, strengthened by Bawaslu, Petitioner argued that KPU had violated Article 158 of Law No. 10 of 2016 since the total population and DPT as well as non-submitted C-6 form affected the result of the final votes number.
