JAKARTA, Public Relations of the Constitutional Court—The 2020 Mamberamo Raya regent election was allegedly rife with structured, systematic, and massive (TSM) manipulation and violations, driving three out of four competing candidate pairs to challenge its results to the Constitutional Court (MK). Those pairs are Dorinus Dasinapa–Andris Paris Yosafat Maay for case No. 81/PHP.BUP-XIX/2021, Robby Wilson Rumansara–Lukas Jantje Puny for case No. 72/PHP.BUP-XIX/2021, and Kristian Wanimbo–Yonas Tasti for case No. 35/PHP.BUP-XIX/2021. 

The three pairs alleged that Candidate Pair No. 4 John Tabo–Ever Mudumi (Respondent), with the support of the Mamberamo Raya KPU (Regency General Elections Commission) and Bawaslu (Elections Supervisory Agency), had committed manipulation. In case No. 81/PHP.BUP-XIX/2021, incumbents Dorinus Dasinapa–Andris Paris Yosafat Maay alleged that the Relevant Party had committed vote buying, which resulted in a significant vote margin in four districts: Rofaer, East Central Mamberamo, Sawai, and Mamberamo Hulu. “This has been reported by the Petitioner to the regency’s Panwas [election supervisory committee], but it was not responded,” said attorney Billy Marcelino Maniagasi.

The Petitioner also alleged that the Relevant Party had played dirty by mobilizing the polling station working committee (KPPS) and polling stations’ Panwas to threat the Petitioner’s witness in Mamberamo Hulu District. “There was also a violation in Kampung Sawai District as the vote acquisition recapitulation minute wasn’t distributed to the Petitioner’s witness. In addition, at TPS 01 of Sorabi Hamlet, a KPPS officer asked for all remaining ballots to be marked,” Maniagasi said before Chief Justice Anwar Usman (panel chair) and Constitutional Justices Enny Nurbaningsih and Wahiduddin Adams.

Therefore, the Petitioner requested that the Court order the regency’s KPU to hold a revote.

Application Requirements Unfulfilled

Similarly, through attorney Achmad Husein Borut, Candidate Pair No. 2 Robby Wilson Rumansara–Lukas Jantje Puny in case No. 72/PHP.BUP-XIX/2021 also alleged that the Relevant Party had committed structured, systematic, and massive (TSM) violations at the KPPS, PPS (polling committee), and PPK (subdistrict election committee) levels. They said that the regency’s KPU certified the Petitioner’s votes at second place at 6,015. “The C1 form hadn’t been distributed by the organizer to the Petitioner through witnesses at the polling stations, where votes for other candidate pairs were allegedly inflated,” Borut explained.

The Petitioner believe the regency’s Bawaslu had ignored the issue and failed to supervise the districts and polling stations during the election. “Candidate Pair No. 2 has sent a complaint to Mamberamo Raya Bawaslu, but it wasn’t responded following procedure,” Borut revealed.

In the petitum, the Petitioner requested that the Court order the KPU to hold a revote in all polling stations across the regency.

Petition Failed

Meanwhile, the petition by Candidate Pair No. 3 Kristian Wanimbo–Yonas Tasti No. 35/PHP.BUP-XIX/2021 was declared fail by the justice panel because the Petitioner didn’t attend the hearing.

In the petition, the Petitioner claimed that vice regent candidate No. 4 Ever Mudumi didn’t meet the application requirements. Based on a certificate by the Head of the Waropen Regency Civil Service Agency (BKD), Ever Mudumi had not resigned from his ASN (state civil apparatus) position. Therefore, the Petitioner requested that the Mamberamo Raya KPU Decree No. 200/PL.02.06-Kpt/9120/KPU-Kab/XII/2020 on the certification of the 2020 Mamberamo Raya Regency election vote counting recapitulation be nullified.

The hearing will resume on Monday, February 8, 2021 at 08:00 WIB to hear the Respondent’s response and the statements of the Relevant Party and Bawaslu and to approve evidence for cases No. 72/PHP.BUP-XIX/2021 and 81/PHP.BUP-XIX/2021.
