East Halmahera Regency Election Challenged by Two Candidate Pairs

JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court’s (MK) Panel I bench chaired by Chief Justice Anwar Usman examined cases No. 26/PHP.BUP-XIX/2021 and No. 30/PHP.BUP-XIX/2021of the 2020 East Halmahera regional head election (pilkada) results dispute on Thursday, January 28, 2021.

On behalf of Candidate Pair No. 1 Thaib Djalaluddin-Noverius Bulango (Petitioner of case No. 26/PHP.BUP-XIX/2021), attorney Fadly S. Tuatany alleged violations by Candidate Pair No. 2 Ubaid Yakub-Anjas Taher. “Massive vote buying by Candidate Pair No. 2 in ten sub-districts has been reported to the regency panwas [election supervisory committee]. There was also mobilization of ASN [state civil apparatus] and massive printing of electronic KTP [resident ID card] three days before voting day,” he revealed.

The Petitioner also alleged a violation regarding the dismissal of regent candidate No. 2 Ubaid Yakub, which hadn’t existed during application. Ubaid Yakub only submitted the East Halmahera Regent Decree No. 0015/100/AP/2020 on this dismissal with pension at his own request. He had previously requested early dismissal from the civil service, but he was still stationed as the Head of the East Halmahera Transportation Office. Therefore, the Petitioner believes this proves data manipulation, legal defect, and maladministration because Ubaid Yakub’s ran for office not only as a civil servant (PNS) who requested dismissal, but as a retired one.

“Therefore, the East Halmahera Regency KPU Decree No. 65/HK.03.1-Kpt/8206/KPUKab/IX/2020 on the certification of the 2020 East Halmahera Regency election vote counting recapitulation dated September 23, 2020 may be annulled by the Constitutional Court with its authority,” Fadly said.

In the petitum, the Petitioner requested that the Court annul the East Halmahera Regency KPU decree and order it to hold a revote at 92 polling stations (TPS) in 10 sub-districts: South Maba, Kota Maba, Maba, Central Maba, North Maba, North Wasiley, Central Wasiley, East Wasiley, Wasilei, and South Wasilei.

Meanwhile, in the East Halmahera Regency election dispute case No. 30/PHP.BUP-XIX/2021, Candidate Pair No. 3 Moh. Abdu Nasar-Azis Ajarat through attorney Muhammad Konoras requested the annulment of the East Halmahera Regency KPU Decree No. 107/HK.03/1-Kpt/8206/KPU-Kab/XII/2020 on the certification of the 2020 East Halmahera Regency election vote counting recapitulation dated December 1, 2020. “In addition, the Petitioner requests that the Court order the East Halmahera KPU to hold a revote (PSU) at several TPS in East Halmahera,” Konoras said.

The hearing would resume on Friday, February 5, 2021 at 10:00 WIB for case 26/PHP.BUP-XIX/2021 and 30/PHP.BUP-XIX/2021 to hear the Respondent’s response and the statements of the Relevant Party and Bawaslu and to approve evidence.
