JAKARTA, Public Relations of the Constitutional Court—Ticket No. 4 in the 2020 West Sumatera gubernatorial election Mahyeldi Ansharullah-Audy Joinaldy was declared winner. However, this was rejected by Ticket No. 2 Nasrul Abit-Indra Catri, who alleged that violations had occurred. This compelled them to file a petition to the Constitutional Court (MK) on Wednesday afternoon, December 23, 2020 questioning the West Sumatera General Elections Commission’s (KPU) decision.

According to Petitioner, ticket Nasrul Abit-Indra Catri, since the start of the candidacy, the Respondent (West Sumatera KPU) had allegedly violated the health screening requirements for the candidates pursuant to Article 7 paragraph (2) letter f of Law No. 10 of 2016 “able physically and mentally and free from the abuse of narcotics.” They stressed that the Respondent had also violated the Decree of the KPU Chairman No. 412/PL.02.2-Kpt/06/KPU/IX2020 on the Technical Guidelines for Physical and Mental Health Assessment Standards as well as the Physical/Mental Health and Narcotics Abuse Assessment Standards in the2020 election of governors/vice governors, regents/vice regents, and/or mayors/deputy mayors (pilkada).

As a result, the results of the candidates’ health assessment was issued by an unauthorized institution—the West Sumatra Indonesian Doctors Association (IDI) Management whereas the hospital authorized by the Respondent was RSUP M. Jamil Padang. Therefore, according to the Petitioner, the results of the medical examination issued by the West Sumatra IDI Management were illegitimate.

In addition, the Petitioner alleged that several non-residents had voted in the West Sumatera gubernatorial election and several that had used the A5 KWK forms had double-voted. They also alleged the Respondent had eliminated the voting rights of 28 eligible voters—2 COVID-19 patients and 26 in-patients at RSUD Pariaman. This had significantly affected their vote acquisition and the number of votes that actually voted.

The West Sumatra KPU declared ticket Mahyeldi Ansharullah-Audy Joinaldy victor in the 2020 West Sumatera gubernatorial election with 726,853 votes (32.43%) or 47,784 votes higher than ticket Nasrul Abit-Indra Catri. As many as 2,313,278 people or around 61.68% of the total eligible voters turned out. The valid votes were 2,241,292 or 96.89% while the invalid were 71,986 or 3.11%.
