JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) received a petition of the 2020 Lamongan Regency (East Java) regional head election (pilkada) results dispute filed by Ticket No. 1 Suhandoyo-Astiti Suwarni. Attorney Regginaldo Sultan filed the petition in person at the ground floor hall of the Constitutional Court building on Monday, December 21, 2020.
The Petitioner challenged the vote counting and recapitulation procedures from the polling stations (TPS) to the upper levels. They alleged that although the number of ballots at the TPS follows the rules—following the final voters list (DPT) plus 2.5 percent—721 TPS were problematic, leading to the inflation of the votes acquired by one of the tickets. They believed the General Elections Commission (KPU) should have fixed it before voting. They also hoped to be allowed to prove their arguments, especially regarding the number of ballots.
Fakfak Regency Election Dispute
On the same day, the Court also received a petition from Fakfak Regency, which was filed in person by Ticket No. 1 Samaun Dahlan-Clifford H. Ndadarmana. They lost to Ticket No. 2 Untung Tamsil-Yohana Dina Hindom.
After the KPU’s announcement on December 17, the Petitioner found out about the decision of the Election Organizer Ethics Council (DKPP) dated December 16, 2020, a day before the KPU passed a decree on a report that the Elections Supervisory Agency (Bawaslu) had been remiss in verifying the tickets. The independent Ticket No. 2 was declared ineligible due to double resident ID cards.
The Petitioner alleged that Bawaslu had sent a letter to recommend re-validation twice, but the KPU let Ticket No. 2 go on running for the election despite their ineligibility.
West Halmahera Election Dispute
On the same day, West Halmahera Regency Ticket No. 2 Danny Missy-Imran Lolory filed a petition through attorney Army Mulyanto directly to the registration desk. The Petitioner alleged that there was structured, systematic, and massive (TSM) violations in West Halmahera Regency election. They claimed the local KPU and Bawaslu was partial in the election. The Petitioner claimed they had discovered a high number of voters in the relocated voters list (DPPh) and the additional final voters list (DPTb).
They also found that in 6 sub-districts many voters used e-ID that didn’t correspond to their residences. They also alleged there were indications of partiality toward one of the tickets.
