Citing Violation, East Luwu Regency Election Ticket Challenges Pilkada

JAKARTA, Public Relations of the Constitutional Court—Citing alleged unlawful mutation of civil servants (PNS) six months by incumbent East Luwu regent/deputy regent after the election tickets were determined, East Luwu ticket No. 2 Irwan Bachri Syam-Andi Muh. Rio Pattiwiri filed a petition challenging the election results, said one of their attorneys Muhamad Ikbal when interviewed by the Constitutional Court media team on Monday, December 21, 2020.

Interviewed after registering the petition and submitting evidence, Ikbal said his client had brought the case to the local Elections Supervisory Agency (Bawaslu) but it wasn’t registered. His client used this in their petition to the Constitutional Court.

The Petitioner also alleged that ineligible voters had participated in the voting. Some of them had valid ID cards and were registered in the additional final voters list (DPTb) but they weren’t known to reside at the villages where they voted.

“We have prepared evidence including the statement of the village head, who claimed not to know those voters. This is our first step to the Constitutional Court to uncover the TSM [structured, systematic, and massive] violations that had occurred before the tickets were certified,” Ikbal explained.

Contradicting Documents

Palu City Ticket No. 3 Hidayat-Hanba Yanti Ponulele through attorney Riswanto Lasdinsalah revealed they filed a petition to prove the KPU’s violation where there was discrepancy between the people who were in the voters list and who actually voted in Palu, Central Sulawesi. Riswanto said, however, the Petitioner didn’t question the vote margin.

“We found contradicting documents. At the moment, we focus on the election organizer,” Riswanto said. He added that four tickets contested the mayoral seat in the 2020 election.

Until Tuesday morning, December 22, 2020, the Court has received 124 petitions of the 2020 pilkada dispute—71 lodged online via simpel.mkri.id, 53 lodged in person. 110 petitions were filed by regency tickets, 13 by mayoral tickets, and 1 by a gubernatorial ticket.
