Court Receives 21 2020 Pilkada Dispute Petitions

JAKARTA, Public Relations of the Constitutional Court—The 2020 North Musi Rawas Regency election results dispute petition was the first offline petition lodged to the Constitutional Court (MK). The petition was filed on Thursday, December 17, 2020 at 10:17:14 WIB by ticket No. 3 M Syarif and Surian. The incumbent ticket challenged the North Musi Rawas KPU (General Elections Commission) decision to certify ticket No. 1 Devi Suhartono and Innayatullah in the 2020 election of North Musi Rawas Regency for violating the election principles (direct, public, free, confidential, honest, and fair).

The Petitioner alleged that the KPU’s decision wasn’t in line with existing laws and the principles of good governance pursuant to Law No. 30 of 2014 in conjunction with the KPU regulations and their hierarchy. Therefore, the Petitioner requested that the North Musi Rawas Regency KPU issue the certification of the 2020 North Musi Rawas Regency regional head tickets that excludes Devi Suhartoni-Innayatullah ticket.

On this day, the Court also received the 2020 election results dispute petitions for Bulukumba Regency lodged by H. Askar-Arum Spink ticket, Karo Regency filed by Jusua Ginting-Saberina Br. Tarigan ticket, and Karo Regency filed by Iwan Sembiring Depari-Budianto Surbakti ticket.

The day before on Wednesday, the Court had received an online 2020 Kaimana Regency election results dispute petition filed by Rita Teurupun-Leonardo Syakema ticket. The ticket challenged the Kaimana KPU’s certification of Freddy Thie-Hasbulla Furuada ticket. They alleged Freddy-Hasbulla had committed electoral violations. On the same day, the Court also received a 2020 Central Lampung Regency election results dispute petition filed by Nessy Kalviya-Imam Suhadi ticket.

Karo Regency Election Dispute 

Based on Article 157 paragraph (3) of the Pilkada Law, the Court is authorized to adjudicate on the disputes over the final certification of regional head election (pilkada) results until a special body is formed. On Thursday, December 17, attorney S. Firdaus Tarigan filed a petition on behalf of Karo Regency ticket No. 1 Jusua Ginting-Saberina Br. Tarigan at a registration desk at the ground floor hall of the Constitutional Court building.

After registering their petition, the petitioner receives the petitioner’s petition filing certificate (APPP) via WhatsApp on the mobile number they have registered to the Court. This method is to optimize the use of information and communications technology (ICT) to curb the spread of COVID-19 in the Constitutional Court.

Until Friday morning, December 18, the Court had received 21 petitions of the elections of governors, regents, and mayors. The petitions were filed both in person and online on the Court’s online petition application.

The petitioners alleged that there were violations in the election. One of these petitioners was Banggai Regency No. 3 ticket Herwin Yatim-Mustar Labolo, whose attorney Rullyandi filed the petition in person at 19:19 WIB. They alleged structured, systematic, and massive (TSM) violations had happened in Banggai Regency pilkada, involving state apparatuses (ASN) and money politics in almost all sub-districts.

“We observed that violations happened in almost 98 percent or 22 sub-districts out of 23 in Banggai. These violations occurred during election silence and voting. We have plenty evidence in the form of photos and video recordings, that shows violations in the regional head election of Banggai Regency,” Rullyandi said.

Different Number of Voters

Taliabu Islands Regency ticket Muhaimin Syarif-Syafruddin Mohalisi also filed a petition in person at 20:16 WIB. They alleged there were different number of voters in the final voters list (DPT) and that which voted in person on voting day. This, they alleged, was caused by voter number inflation, which is done by forging voting certificate and resident IDs (KTP), so that the voters exceeded the number in the DPT.

“We’re sorry the election went unfairly, so the village heads and the Home Ministry’s Population and Civil Registry (Dukcapil) facilitated the procurement of thousands of certificates, and many underage voters voted. What was even more damaging is that the entire polling stations (TPU) had very different voter turnouts from that in the KPU’s tabulation. In addition, a new style of money politics occurred in which the incumbent [give away] cows in all villages. Plus there is much evidence of money direct handover to village officials. We are very confident that the Court will decide this case fairly,” Muhaimin stressed.
