JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) serves to enforce and guard the Constitution. Modern judiciary will be realized if justice seekers can obtain justice without having to go to the courtroom, said Secretary-General M. Guntur Hamzah at the review of his book Modern Judiciary, Implementation of ICT on Monday, December 14, 2020 virtually. The event was organized by the Computer Science Faculty of Mercu Buana University.
Guntur then quoted philosopher Jeremy Bentham, “Publicity is the very soul of justice. It is the keenest spur to exertion and the surest of all guards against improbity.” Transparency is the spirit of justice, he said.
He said courage is necessary in implementing information and communications technology (ICT) as well as a conviction that the technology to apply will provide ease to the community. The Constitutional Court as the product of the Reform, he said, was driven by the first constitutional justices to be a modern judicial institution.
Guntur said modern judiciary is committed to the use of ICT. In the Constitutional Court, this is shown in the uploading of the decisions to the Court’s website after being read out in the ruling hearing, which the public can access any time and from anywhere.
“Modernity is inseparable from the use of technology. However, technology must be run by people who have integrity because without it, technology is subject to abuse,” he said.
He added that the Constitutional Court had started reducing paper, expanding the office beyond the Court building, and adopting the “padang rice” philosophy of providing something before being asked. However, building modern judiciary requires a large budget.
In the discussion session, Eugenius Kau Suni (Director of PT Multimedia Ransel Pro) and Untung Surapati (Managing Partner of Untung Surapati Law Firm & Partner) reviewed the book. Eugenius Kau Suni said reading the book was akin to learning both IT and the field of law at the same time. He added that the book also discussed how to litigate in the Constitutional Court.
