JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) held a simulation of the 2020 regional head election (pilkada) results dispute settlement on Friday afternoon, December 11, 2020 at the front lobby of the Constitutional Court building. Several officials of the Registrar’s Office and the Secretariat General of the Constitutional Court oversaw the simulation, including Secretary-General M. Guntur Hamzah, Chief Registrar Muhidin, coordinators of the 2020 pilkada dispute task force, and all staff members in the administrative unit.

Guntur said the escalating COVID-19 pandemic demanded that the Court adopt a combination of work-from-home and work-from-office policies for the 2020 pilkada dispute task force. “The Court implements the [work-from-home and work-from-office] models in handling pilkada disputes under strict health protocols [such as] wearing a mask, washing hands, maintaining safe distance, and measuring body temperature in order to eliminate and stop the chain of COVID-19 transmission. There is no guarantee that a [negative] swab results show safety from COVID-19 [as] people come and go during the 2020 pilkada dispute resolution,” he said before opening the simulation.

Guntur added that staff members who have comorbidities must inform their direct supervisors. It is recommended that such staff members work from home, but they must account for their work and carry out their work with dedication, discipline, and professionalism. In addition, the must show the output of their work and report it.

Guntur also reminded that staff members, especially those in the pilkada task force, maintain their integrity and say no to gratuity and corruption. “If you can’t refuse gifts, report them to the Gratuity Control Unit (UPG), because the Constitutional Court already offers incentives in the form of HDPP,” he said.

Optimal Services 

Meanwhile, Chief Registrar Muhidin said the 2020 pilkada dispute settlement simulation was the first step to optimal and safe services for the litigating parties. “We will see how each role in the task force functions. We will ensure our system operates and that the task force understand their roles and functions. Please take note of the regulations concerning pilkada dispute settlement—the laws, the Constitutional Court regulations, the Chief Constitutional Justice regulations, et cetera,” he said.

The task force simulated IT devices on all process in the 2020 pilkada dispute settlement, from accepting petitions and documents, to financial administration. As petitions can be filed in person or online, any time a petitioner comes to the Court to file their petition, strict health protocols are implemented. Anyone who lodge a petition will be received by an officer who ask for the petition and other information such as resident ID card. Then, the petitioner will be directed to a machine that generates the NUP (petition queue number).
