JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) held a work meeting and signed a staff integrity pact on Saturday, December 5, 2020. The event on “Realizing Constitutional Democracy in Concurrent Pilkada in 2020-2021 amid the Covid-19 Pandemic” took place at the ground floor hall. Staff members and employees of the Constitutional Court attended the event virtually.
In his opening speech, Chief Justice Anwar Usman said that the work meeting evaluates a work’s performance and discusses the planning for the following year. He added that the weaknesses of the Court’s performance in the 2019 concurrent general election (pemilu) should be noted.
“It is impossible for the Court to satisfy all parties. The most important thing is that everything is done with good intention, sincerely, and for religious worship. [Prophet Muhammad] advised in a hadith ‘Actions are according to intentions,’” he said before Deputy Chief Justice Aswanto, Constitutional Justice Wahiduddin Adams, Constitutional Justice Suhartoyo, Constitutional Justice Manahan M. P. Sitompul, Constitutional Justice Daniel Yusmic P. Foekh, Secretary-General M. Guntur Hamzah, Chief Registrar Muhidin, and structural and functional officials of the Court.

Justice Anwar said that the 2020 regional head election (pilkada)is faced with an extraordinary challenge, the COVID-19 pandemic, causing a major dilemma. On the one hand, the state is obligated to fulfill the people’s constitutional rights in democracy. On the other hand, it must adhere to strict protocols set by the Health Ministry to guarantee the people’s health.
Therefore, IT will be used in the pilkada results dispute resolution, from registering petitions and dossiers, scheduling hearings, implementing the hearings, to arriving at decisions. The Court has in fact use IT and pioneered it by conducting online hearings. “However, despite all this, there is much room for improvement, so I hope the IT team continuously conduct simulations so all equipment will work optimally,” he said.
Maintaining Integrity
Justice Anwar also stressed the need for integrity. Public trust in the Court must be maintained through a show of integrity for a just election. With integrity, the Court will realize transparent and reliable judiciary that can be accounted for before God and the people.
“As an effort to maintain integrity, at the beginning of this meeting we have signed an integrity pact. Hopefully our words and actions will match,” he said.
Work Meeting
Secretary-General M. Guntur Hamzah reported that the meeting would take place for two days on Saturday to Sunday, December 5-6, 2020. He admitted that this year’s meeting would be challenging, but motivated the participants to carry out their duties with optimism.
He explained that the meeting would discuss four main issues: evaluation of the 2018 pilkada, the Court’s performance in 2020, the preparations for the 2020 pilkada dispute resolution, and the action plan of the Registrar’s Office and the Secretariat General post-2020 pilkada.
“To keep the discussions focused, some materials have been prepared. The discussion will be divided into several sessions. Despite the abundant materials to discuss, directed sessions hopefully will obtain optimal results, especially regarding matters that require direction and feedback from the justices,” he said at the meeting that was emceed by Fazlur El Islami.
At this event, Secretary-General M. Guntur Hamzah, Chief Registrar Muhidin, Chief Justice Anwar Usman, and Deputy Chief Justice Aswanto signed a staff integrity pact. The event will take place for two days, Saturday to Sunday, December 5-6, 2020 at the ground floor hall. As many as 359 participants—constitutional justices, members of the ethics council, structural and functional officials, as well as staff members and employees of the Constitutional Court attended the event virtually.
