JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) issued a decree on the judicial review of Law No. 11 of 2020 on Job Creation on Wednesday, November 25, 2020 in the plenary courtroom. The case was petitioned by Zakarias Horota, Agustinus R. Kambuaya, and Elias Patege. In the Decision No. 95/PUU-XVIII/2020, the Court grants the withdrawal of the Petitioners’ petition.

Chief Justice Anwar Usman stated that the Court had received the petition on October 20, 2020. Then through a letter dated October 21, 2020, attorney Zico Leonard Djagardo Simanjuntak and peers stated that the power of attorney was withdrawn.
Based on a letter dated October 19, the Petitioners had granted Juhaidy Rizaldy Roringkon and peers a power of attorney. The letter was received by the Court’s Registrar’s Office on October 20 to file a formal and material judicial review petition of the Job Creation Law. Pursuant to Article 28 paragraph (4) and Article 34 paragraph (1) of the Constitutional Court Law, a decree on the formation of justice panel was issued to examine the case at a hearing on October 27. However, the Court received a withdrawal request from the attorneys dated November 9, which the Registrar’s Office received on November 10.
“At a preliminary examination hearing on November 12, 2020, the Court asked the Petitioners about the petition withdrawal letter and the Petitioners’ attorney confirmed [it],” said Justice Anwar to the litigants who attended the hearing virtually. Article 35 paragraph (1) of the Constitutional Court Law states that a withdrawal request means that the a quo petition cannot be re-filed. In addition, a justice deliberation meeting (RPH) on November 16, 2020 decided that the withdrawal request was legally grounded. Consequently, the Petitioners are no longer able to file the a quo petition and the Registrar’s Office was ordered to record the withdrawal of the Petitioners’ petition in the constitutional case registration book and to return the copies of the dossier to the Petitioners.
