Job Creation Law Passed, Workers Unions File Petition

JAKARTA, Public Relations of the Constitutional Court—Almost a month ago today (October 5, 2020), the DPR (House of Representatives) plenary session ratified the “Cipta Kerja” bill into Law No. 11 of 2020 on Job Creation. It was promulgated after being signed by President Joko Widodo on Monday evening, November 2, 2020.

The newly-passed law was met with criticism from several workers unions. The All-Indonesia Workers Union Confederation (KSPSI) and the Confederation of Indonesian Trade Unions (KSPI) filed a judicial review petition against the law to the Constitutional Court. The Court’s website recorded that the Registrar’s Office had received the petition on Monday, November 2, 2020 at 22:45 WIB.

In the petitum, the Petitioners requested that the Court declare “the semicolon (;)” and the word “or” after the phrase “private job-training agencies” in the provision of Article 13 paragraph (1) letter b contained in Article 81 point 1 of the Job Creation Law, which reads, “Job training carried out by: a. state job-training agencies; b. private job-training agencies; or c. corporate job-training agencies,” unconstitutional and not legally binding so that Article 13 paragraph (1) letter b will read, “private job-training agencies.”

They also requested that the phrase “… and corporate job-training agencies as referred to in paragraph (1) letter c” in Article 13 paragraph (4), which is contained in Article 81 point 1 of the Job Creation Law be declare unconstitutional. The article reads in full: “State job-training agencies as referred to in paragraph (1) letter c shall register their business to the agency in charge of manpower affairs in the regency/city.”
