JAKARTA, Public Relations of the Constitutional Court—Chief Justice Anwar Usman opened the Trainers Convention on Regional Election Dispute, Friday, October 2, 2020 at the Constitutional Court. The virtual technical assistance program was done in preparation for the upcoming regional elections (pilkada) on December 9. “The pilkada is problematic. Regardless, we must prepare well,” he said.
He encouraged participants to work with the intention of worship. “Human beings can’t work beyond their abilities, so good cooperation among officials are needed,” he said.
The event hosted by the Constitutional Court's Pancasila and Constitution Education Center also presented Deputy Chief Justice Aswanto, Constitutional Justice Saldi Isra, and Constitutional Justice Suhartoyo. The participants were substitute registrars, researchers, court officials, and assistants to judicial judges. “There are changes in the procedure in the (Constitutional Court Regulation), which we will form a common perception on through this event,” Justice Aswanto said.
He said that in the previous regulation, a petitioner can file numerous petitions, but now there is a limit to one in the first 3x24 hours. “So, [petitioners] won’t have to come to the Court multiple times,” he said. The petition revision can also be filed only once in the second 3x24 hours. Any further revision will have to be conveyed at the preliminary hearing.
Relevant Parties Must Be Proactive
Constitutional Justice Saldi Isra explained that the new regulation made it easy for the registration officers, so that the workload previously concentrated on them is now transferred to the constitutional justices. He revealed that he had seen an instance where the respondent’s response submitted at the court hearing differed from that submitted to the justices. He also said trainers in the following week will get the same materials and that while the speakers improvise, they will not stray too far off the materials.
Constitutional Justice Suhartoyo said that the Constitutional Court Regulation No. 5 of 2020 on the Procedural Law on the Dispute Cases of the Election of Governors, Regents, and Mayors encourages the election tickets to prepare the evidence. “They must be prepared to be petitioners or relevant parties by continuously monitor the pilkada cases on mkri.id,” he said.
