Court Approves Withdrawal of Petition on State Ministry Law

JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) issued a decree approving the withdrawal of the judicial review petition of Law No. 39 of 2008 on State Ministries, which was filed by Aristides Verissimo de Sousa Mota. He had requested the judicial review of Articles 10 and 15 of the State Ministry Law. He questioned the number of deputy ministers in the cabinet.

"The [Court] decrees, grants the withdrawal of the Petitioners’ petition,” said plenary chairman Chief Constitutional Justice Anwar Usman along with the other constitutional justices in the pronouncement of the Decree No. 30/PUU-XVIII/2020 on Tuesday (23/6/2020). The hearing was held in accordance with the COVID-19 health protocols set by the Indonesian Health Ministry and the World Health Organization (WHO), such as by wearing a mask, gloves, checking temperatures, and applying physical distancing. 

The decree states that the Court had received de Sousa Mota’s petition on April 22, 2020. Then, the Court’s Registrar Office recorded it in the constitutional case registration book (BRPK) on May 5 as case No. 30/PUU-XVIII/2020 regarding the judicial review petition of Law No. 39 of 2008 on State Ministries against the 1945 Constitution.

In the preliminary judicial review hearing on May 15, the justices had advised the Petitioner to revise the petition, followed by the Petitioner requesting to withdraw the petition. Article 35 paragraph (2) of the Constitutional Court Law stipulates that when a petition is withdrawn, it cannot be re-filed. Then in a deliberation meeting (RPH) on June 19, the constitutional justices decided that the withdrawal was legally justified and that the Petitioner cannot re-file the petition.
