Constitutional Court Offers Public Services and Access to Justice

JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) not only offers public services, but also gives access to justice that is the right of every citizen, said Secretary General of the Constitutional Court M. Guntur Hamzah in A focus group discussion entitled “Brainstorming of Experts on the Quality of Constitutional Case Support Services” organized by the Constitutional Court and the State University of Jember (UNEJ) on Sunday (21/6/2020) via Zoom.

The Constitutional Court always try to improve as its work is related to citizens, from the public, politicians, the government, and the parliament, by making decisions that are in line with constitutional values. Therefore, the Court equips itself with personal, internal, and collective independence.

"All components of the Constitutional Court, starting from the justices and registrar staff, have independence in carrying out their duties," explained Guntur before structural and functional officials of the Constitutional Court as well as academics from the State University of Jember.

Guntur added that the Court also has impartiality, meaning that it remains neutral in making decisions, which can be implemented not only by the appointed institution, but as part of the solution to justice. Therefore, integrity and interconnection in the Constitutional Court are not only limited to e-court, but applies to all existing systems.

"So, in the Constitutional Court there are two [distinguishable but inseparable] working areas: general administration and judicial administration. These two parts are the support system that the Court has in exercising its authority," Guntur said.

Electronic-Based Judiciary

In order to carry out its authorities, in addition quality human resources (HR), the Constitutional Court also requires regulations and electronic-based work systems. The president initiated this program, which the Constitutional Court translated into an electronic-based justice system (SPBE) through judicial administration and general administration.

Judicial administration is the management of cases and starts working long before a case is heard. It covers technical guidance and special socialization activities such as the settlement of regional head general election and general election cases in 2019. Through this activity, the Court hopes to facilitate justice seekers to understand the Court’s rules and other regulations that apply in the elections. The Court also enables online submission of petitions on its website.

"Therefore, justice seekers need not expend a lot for accommodation and so on because the Court has facilitated everything through simpel.mkri.id, which can be accessed on mkri.id anywhere and at any time," Guntur explained.

For general administration, the Court has a stable platform so that all work can be carried out ICT-based or using e-office through the Dynamic Archival Information System (SIKD), which makes workflow more efficient. Files, materials, and documents are processed digitally. The Constitutional Court maintains the authenticity, validity, and originality (OVO) of documents so that all existing documents have passed the due diligence.

"The Constitutional Court [is easily accessible] on Click MK. Everything that runs at the Constitutional Court is delivered digitally to the public," said Guntur. (Sri Pujianti/LA)
