NEW DELHI, Public Relations of the Constitutional Court—Deputy Chief Constitutional Justice Aswanto attended the International Judicial Conference 2020 on Judiciary and The Changing World held by the Supreme Court of India on Saturday (22/2/2020) in New Delhi, India.
The event was opened and attended by Indian Prime Minister Shri Narendra Modi. In the event, Justice Aswanto delivered a presentation on Constitution in A Changing World: Static or Dynamic Interpretation along with judges from Australia, Nepal, and Nigeria. Justice Aswanto explained how the constitutional justices interpreted the Constitution through the judicial review mechanism.
According to Justice Aswanto, judicial review is the main means to protect the constitutional rights of citizens from laws that are unconstitutional. The constitutional justices have the freedom to use various interpretive approaches in making decisions.
In addition, Justice Aswanto said that the constitutional justices make decisions not only based on the interests of the current generation, pay attention to the interests of future generations. He also talked about constitutional transformation in Indonesia, one of which is that petitioners can file a petition not only related to private individuals but also legal entities, organizations, customary law communities, and state institutions. They can request a review of the constitutionality of a law made by the House of Representatives (DPR) and the Government to the Constitutional Court.
The event was also attended by Chief Justice of the Indian Supreme Court Sharad A. Bobde, Attorney General of India K.K. Venugopal, Indian Supreme Court Justices Nageswara Rao and N.V. Ramana, and Indian Minister of Law, Communication, and IT Shri Ravi Shankar Prasad.
The next day on Sunday (23/2/2020), the conference had the fifth session on The Role of Judiciary in Protecting Privacy of Citizens in the Internet Age, about the role of review of the protection of citizens\' privacy rights.
