JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) held the revision judicial review hearing of Law No. 11 of 2008 concerning Information and Electronic Transactions (ITE) on Wednesday (8/1/2020). The case No. 78/PUU-XVII/2019 was petitioned by PT Nadira Intermedia Nusantara

Through attorney Muhammad Zen Al-Faqih, the Petitioner conveyed several points of revision. "First, we made changes relating to the Principal [Petitioner] who filed this petition because it turns out that there was a change in the deed. There was an addition to the names of the directors, Mr. Rahadi Purnama Arsyad," Al-Faqih said to the justice panel led by Constitutional Justice Arief Hidayat.

The second revision is the elimination of the articles of the Broadcasting Law. The third is the reinforcement of the legal standing in accordance with the recommendations of the constitutional justices during the preliminary hearing. 

"In addition [we reduced the laws being reviewed]. Originally [we challenged] three laws, [but now only] two laws. The articles in the ITE Law and in the Copyright Law remain," Al-Faqih explained. 

In the preliminary hearing, the Petitioner argued that they were aggrieved by the enactment of Article 25 paragraph (2) letter a of the Copyright Law for rebroadcasting broadcasts. The Petitioner, who implemented the Broadcasting Law and rebroadcasted at least 10% of the program by the Television of the Republic of Indonesia Public Broadcasting Administration TVRI and private broadcasting institutions (private TV stations that broadcast on a free-to-air basis), was reported to the police by PT MNC Sky Vision for broadcasting the copyrighted content owned by TV MNC Group.
