YOGYAKARTA, Public Relations of the Constitutional Court—In a forum group discussion on "The Responsiveness of Constitutional Law and State Administrative Law in the Acceleration of National Development," Constitutional Justice Enny Nurbaningsih stated that constitutional law is the basic law of the land, so if the foundation of the law is shaken, it will be dangerous. Therefore, it is important to strengthen the state administration law. The FGD was part of the 2019 Constitution and Anti-Corruption Festival, collaboration between the Constitutional Court, the People’s Consultative Assembly (MPR), the Corruption Eradication Commission (KPK) and Gadjah Mada University (UGM).
Moreover, she added, the legislative body in Indonesia completes the legislation only at the end of its term of office. According to her, this is an indication of political interests. "The legislation system is swinging, the House of Representatives completes the legislation [at the end of] its term of office and it is apparent that there are political interests. Therefore, [constitutional law] as the basic law of the land must be strong," she stressed on Tuesday (10/9/2019) at Gadjah Mada University, Yogyakarta.
Justice Enny mentioned Malaysia, which adapted the British regulatory system in which it do not issue many legal products. This has an impact both on the Government and the country\'s economy. Indonesia, she added, has not yet done this. She also compared Indonesia to Vietnam. According to her, Vietnam is far more selective in issuing regulations, so not many regulations in Vietnam have an impact on the number of incoming investors. "Indonesia has not replicated this. This put Indonesia in a very bad position. Vietnam has implemented good regulatory practices and this has made Indonesia unattractive to investors," she said.
During the FGD, Justice Enny Nurbaningsih handed over the position as Chairperson of Constitutional Law and State Administrative Law Lecturers Association (APHTN-HAN) of D. I. Yogyakarta Province to UGM Law Faculty Dean Andi Omara, as she had been made a constitutional justice to replace former justice Maria Farida Indrati, who had retired. (Lulu Anjarsari)
