JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) ordered a recount in the electoral district (Dapil) 4 of Surabaya City for DPRD seats in Decision No. 183-04-14/PHPU.DPR-DPRD/XVII/2019 in the case petitioned by the Golongan Karya Party (Golkar). The Panel of Justices argued that Surabaya City KPU did not carry out Bawaslu\'s order to revise the filling of the DA1 Plano form with a copy of the DA1 form.

"Orders the Respondent to carry out a recount (PSU) at TPS [polling station] 30 and TPS 31 of Putat Jaya Village and TPS 50 of Simomulyo Sub Village," explained Chief Justice Anwar Usman with the other eight constitutional justices on Wednesday (7/8/2019).

In the legal consideration read out by Constitutional Justice Enny Nurbaningsih, the Constitutional Court made a conclusion that there had been an error in vote recording at TPS 30 and TPS 31 of Putat Jaya Village and TPS 50 of Simomulyo Village. This was admitted by the Respondent\'s witness in the hearing, who mentioned a mistake in recording the Plano DA1 form to the DA1 form.

Actually the Surabaya City Bawaslu issued a decision responding to this incident by requesting a recount in these TPS. However, Bawaslu\'s decision was not carried out by the Respondent because there was no technical direction on how to do it. "On this basis, the Constitutional Court considered the need for a recount at those locations," explained Justice Enny.

The Constitutional Court (MK) rejected the petition on Dapil Sampang 3 for DPRD seat because the Petitioner\'s argument was not proven legally. Meanwhile, for Dapil Pamekasan 1, the petition couldn\'t be accepted because the Court considered the Petitioner not serious in submitting the petition.
