JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) granted the petition No. 76-03-14/PHPU.DPR-DPRD/XVII/2019 filed by the Indonesian Democratic Party of Struggle (PDI-P) for Dapil Trenggalek 1 for Trenggalek Regency DPRD , East Java. In the 2019 DPR-DPRD (House of Representatives-Regional Legislative Council) election results dispute (PHPU) of East Java Province, the Petitioner argued about vote discrepancy between the Petitioner and other political parties at TPS 4, 12, and 20 of Surodakan Village and at TPS 12 and 16 of Sumbergedong Village, Trenggalek Regency, which impacted the Petitioner’s vote acquisition.
This fact, Justice Arief added, was in accordance with the statement of witness Doding Rahmadi, which reinforced the differences that occurred at the polling stations. So, as the Constitutional Court was not convinced, at the hearing on July 23, 2019, the Respondent said that they had opened the ballot boxes to take the C1 Plano form photocopy. However, the Respondent was unable to ascertain the differences in vote acquisition intended by the Petitioner.
"According to the Court, it is impossible that two vote counts at the same level have different results," Justice Arief explained in the ruling hearing of the PHPU case of the 2019 Election of DPR, DPD, and DPRD on Wednesday (7/8/2019) .
Based on these considerations, the Court ordered a recount of TPS 4, 12, and 20 of Surodakan Village and at TPS 12 and 16 of Sumbergedong Village to elect DPRD of Dapil Trenggalek 1.
“The verdict declares the annulment of the KPU decision on the determination of election results for Regency DPRD for Dapil Trenggalek. Orders the KPU to recount the votes at TPS 4, 12, and 20 of Surodakan Village and at TPS 12 and 16 of Sumbergedong Village for all political parties contesting in the 2019 Elections,” said Chief Justice Anwar Usman reading out the verdict in the Plenary Courtroom of the Constitutional Court.
