JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) held the 2019 DPR-DPRD (House of Representatives-Regional Legislative Council) legislative election results dispute (PHPU) hearing of Southeast Sulawesi Province on Monday (24/7/2019). The hearing, presided over by Constitutional Justice I Dewa Gede Palguna, with Constitutional Justices Suhartoyo and Wahiduddin Adams, heard the statements of witnesses for the Petitioners and Respondent.
Previously, the Prosperous Justice Party (PKS) in case No. 09-08-29/PHPU.DPR-DPRD/XVII/2019 had questioned the votes for the electoral district (Dapil) of Southeast Sulawesi 6 for the Provincial DPRD seat. PKS alleged inflated votes had benefitted the Crescent Star Party (PBB), causing PKS to lose a seat in this electoral district.
The Petitioner’s witness Burhan mentioned that there was an error in inputting votes, which reduced PKS\\'s votes. This occurred in Momea Village, Tongauna District, Konawe Regency. "In TPS 1, TPS 2, and TPS 3. PBB should have received 73 votes. But in the DA1 form it was changed to 93 votes," he explained. Burhan said it did not match the C1 form they had.
In addition, Burhan, in the three polling stations (TPS) PKS’s votes were reduced. PKS should have received 13 votes but the Respondent determined 11 votes. However, he admitted that he did not raise an objection at the district recapitulation level and all witnesses signed the form.
Another witness for the Petitioner, Supriatno, stated that PBB’s votes had been inflated at TPS Torea of North Konawe Regency. According to the Petitioner, PBB should have received 0 votes based on the C1 form, but on the DA1 form, it was changed to 43 votes. "Our witness was not at the polling station. The witness was unable to attend in the recapitulation at sub-district level," he explained as witness coordinator at the sub-district level.
In response, North Konawe KPU Commissioner Armanto dismissed all of the Petitioner\\'s allegations because in the vote recapitulation, hologrammed C1 forms were compared and then inputted in the DAA1 form. "There was a recheck and there was no objection from the Petitioner, [who] signed [the form] during the vote recapitulation," he explained.
Similarly, the Respondent\\'s witness Ade Suerani dismissed all the allegations by the Petitioner\\'s witnesses because in the vote recapitulation in the sub-district, the hologrammed C1 form was matched.
Besides the aforementioned cases, the hearing also heard case No. 198-05-29/PHPU.DPR-DPRD/XVII/2019 submitted by the National Democratic (Nasdem). (ArifSatriantoro/NRA/RD)
