JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) held a further hearing of the 2019 DPR-DPRD (House of Representatives-Regional Legislative Council) Election Results Dispute (PHPU) of Central Java Province on Thursday (25/7/2019) at 07.30 WIB. The Panel 2 was presided over by Deputy Chief Justice of the Constitutional Court Aswanto, with Constitutional Justices Saldi Isra and Manahan M. P. Sitompul.

The Indonesian Democratic Party of Struggle (PDIP) as the Petitioner in the case No. 75-03-13/PHPU.DPR-DPRD/XVII/2019 presented Bachrun Setiawan as a witness of PDIP in the Sub-District Election Committee (PPK) Lumbir, Banyumas Regency.

“The vote recapitulation of the election of DPRD members in PPK Lumbir took place for three days. PDIP received 4,379 votes while the Gerindra Party received 1,885 votes. Then, after the vote count at the district level, there was dispute due to the C1 [form] from witnesses at the TPS [polling stations] and [we] compared it with the DAA1 [form]. For example, in TPS 1 of Cidora, Gerindra Party received 16 votes in the C1 form, but in the DAA1 form the Gerindra Party received 21 votes. This means there were 5 additional votes," said Bachrun, who also explained that the discrepancy between the C1 form and the DAA1 occurred in 20 polling stations in Lumbir Sub-district, Banyumas Regency.

Bachrun added that the dispute over the recapitulation at the district level caused the PDIP’s voted to decrease. According to Bachrun, the results of the vote recapitulation at the district level were received from one of the legislative candidates who participated in the election, because Bachrun was part of the candidate’s campaign team.

Another PDIP witness Whisnu Aditya explained about PDIP\'s vote acquisition in the 2019 Legislative Election in Central Java Province. "PDIP\'s vote acquisition according to the KPU was 598,419 votes. However, according to us as the Petitioner, PDIP received 599,221 votes. Thus, there was a difference," said Whisnu, who was also part of the National Elections Witnesses Body (BSPN) of Central Java PDIP 6 to collect data from the witnesses and subsequently validate it.

Furthermore, the Great Indonesia Movement Party (Gerindra) as the Petitioner in case No. 158-02-13/PHPU.DPR-DPRD/XVII/2019 presented Indra Wijaya Kusuma as a witness and voter at TPS 13 North Kramat, North Magelang in the election of Magelang City DPRD members. Indra said that the names of candidates to be elected were not in the ballot papers.

The absence of the names of candidates to be elected was confirmed by Joko Purwanto, a witness of the Gerindra Party. In the election of Magelang City DPRD, Joko voted at TPS 12 of North Kramat as well as serving as witness coordinator in North Kramat Village. After being investigated, it was discovered that the names of candidates were not available because the ballots were accidentally mixed up with those of another electoral district.

Responding to the ballot paper switch such as at TPS 13 and TPS 12 of North Kramat, North Magelang, chairman of the Central Java Provincial Elections Supervisory Agency (Bawaslu) M. Fajar S. A. K. Arif confirmed that the ballots that were exchanged and marked were declared valid and tallied into the parties’ votes.

Meanwhile, the Nasdem Party as Petitioner in case No. 190-05-31/PHPU.DPR-DPRD/XVII/2019 presented Prio Hananto as a witness and candidate from Nasdem for the election of DPRD members. Prio explained that there was a dispute among 8 candidates including himself when he was a witness for the Nasdem at the provincial level. According to Nasdem, the total votes for the Democratic Party were 20 votes, but the Respondent wrote it as 37 votes.
