JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) held the 2019 DPR-DPRD (House of Representatives-Regional Legislative Council) Election Results Dispute (PHPU) hearing of Banten Province and Gorontalo on Tuesday (23/07/2019) at 14.00 WIB. Panel 2 was presided over by Chief Justice Aswanto with Constitutional Justices Saldi Isra and Manahan M. P. Sitompul.
The Nasdem Party’s witness Eka Puspita Dewi explained that she had been mandated to witness the vote recapitulation in Pondok Aren Subdistrict, South Tangerang (Tangsel) City, Banten Province. Eka revealed that as a witness in the sub-district, she did not have all copies of the vote acquisition at the polling station (TPS) level, and only obtained all copies of the vote acquisition at the vote recapitulation at the sub-district level.
“During the vote count at TPS 47 of West Pondok Kacang the ballot boxes were opened and revised. However, the revised results were not recorded in the existing forms and the Nasdem Party lost one vote. A similar incident also occurred at TPS 10 of West Pondok Kacang. The Nasdem Party also lost one vote,” Eka said before the Panel 2 Court.
"At TPS 10 of West Pondok Kacang, the computer used to record the vote acquisition broke down and the revision of the numbers in the form was done by the officers only when the witnesses were resting and some were not at the location," Eka said.
Eka\'s testimony was corroborated by Andry Ricky Ticoalu, who explained that there were irregularities in the process of vote recapitulation in Pondok Aren Sub-district. According to Andry, the Pondok Aren Sub-district Election Committee (PPK) mostly matched the data with that of the witness of the Prosperous Justice Party (PKS).
Meanwhile, in the examination of the 2019 DPR-DPRD PHPU of Gorontalo Province, through MK\'s video conference facility at the Faculty of Law (FH) of Gorontalo State University, the witness of the Petitioner (PKS) Zumair M. Ismail conveyed his testimony.
"The objection raised by all parties’ witnesses in the vote recapitulation of Kota Barat Subdistrict in Gorontalo was because of the discrepancy between the total valid and invalid votes and the number of voters who used their right to vote," Zumair said.
Zumair explained, Bawaslu verbally recommended a revote of the legislative election for the use of voting right for voters listed in the Additional Voters List (DPTb).
"However, because the recommendation was made towards the end of the deadline for a revote, it was not implemented," Zumair said. (Nano Tresna Arfana/NRA)
