JAKARTA, Public Relations of the Constitutional Court—Following up on the Elections Supervisory Agency’s (Bawaslu) recommendation for a postal revote for Kuala Lumpur, the Overseas Elections Committee (PPLN) of Kuala Lumpur had made preparations and delivered the ballot papers for the revote. This was conveyed by the General Elections Commission’s (KPU) attorney Sutejo in the second hearing of the DKI Jakarta Province DPR-DPRD (House of Representatives-Regional Legislative Council) legislative election results dispute (PHPU) in the Panel 1 Courtroom of the Constitutional Court on Tuesday (16/7/2019).

Sutejo added that in order to prepare for the postal revote, the Kuala Lumpur PPLN had revised the deadline of ballot submission, ballot receipt, and ballot count.

“In conclusion, there was Bawaslu’s recommendation No. 0866/K.Bawaslu/PM.06.00/IV/2019, where a revote had been done in Kuala Lumpur through postal service for as many as 319,293 eligible voters,” Sutejo elaborated before the Court presided over by Chief Justice Anwar Usman, with Constitutional Justices Arief Hidayat and Enny Nurbaningsih on the bench.

In relation to petition No. 195-05-11/PHPU.DPR-DPRD/XVII/2019, Sutejo added, the total ballots received by the PPLN sent by May 15, 2019 are 85,085 and until the final vote counting, there were 62,278 votes. Based on the vote recapitulation, the final vote counting of all methods [show that] the Nasdem Party received 22,558 votes, the Democratic Party received 7,517 votes, and PKS received 7,028 votes.

At national plenary meeting, Sutejo added, 60,278 ballots stamped May 15, 2019 were received by PPLN on May 16, thus not considered. Therefore, the valid postal ballots were only 22,807. “Therefore, the votes for the political parties are for Nasdem 126,439 votes, for the Democratic Party 3,565 votes, and for PKS 6,624 votes.

In the same session, Panel I also head the statement from the Elections Supervisory Agency (Bawaslu) on petition No. 150-02-11/PHPU.DPR-DPRD/XVII/2019 filed by the Great Movement Party (Gerindra). DKI Jakarta Bawaslu Chairman M. Jufri gave a statement related to the argument of vote purging experienced by Gerindra candidate R. Saraswarti D. Djojohadikusumo, which occurred in several polling stations (TPS) in Dapil (electoral district) DKI Jakarta 3. Based on Bawaslu’s observation, for example, in Koja Village such margin of votes was not found. “There were no findings or reports by the Petitioner in relation to allegation of violations or purging of the Petitioner’s votes at those polling stations,” Jufri said.

Inaccurate Argument

The justices of Panel I also heard the Respondent’s response to petition No. 174-04-11/PHPU.DPR-DPRD/XVII/2019 filed by Golkar. The Respondent’s attorney Effendi said that Petitioner alleged vote margin between the Petitioner and the National Mandate Party (PAN) resulting from a comparison based on the Petitioner’s C1 and the Respondent’s DAA1 in seven villages. Based on the vote count results, the allegation was not true. “So, the Petitioner’s argument referring to every village on the vote margin between them and PAN is inaccurate and groundless. Therefore, the Petitioner’s petition must be rejected or ruled out,” Arif explained.

Aside from hearing the Respondent’s responses to the aforementioned cases, the panel also heard the Respondent’s response and the statements of the Relevant Parties and Bawaslu to petition No. 29-01-11/PHPU.DPR-DPRD/XVII/2019 filed by Ahmad Iman, DPR RI candidate from the National Awakening Party (PKB). Before concluding the first session of the day, Chief Justice Anwar informed that the schedule for the next hearing would be announced by the Court’s Registrar Office.
