KPU Clarifies Petitions of NasDem, PKB, and Democrat

JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) held a hearing on the DPR-DPRD (House of Representatives-Regional Legislative Council) legislative election results dispute (PHPU) of Banten Province on Tuesday (16/7/2019) at 08:00 WIB. The General Election Commission (KPU) as the Respondent responded to arguments for the petitions of political parties in Panel 2 Courtroom. The Panel 2 was presided over by Chief Justice Aswanto, with Constitutional Justices Saldi Isra and Manahan M. P. Sitompul.

The KPU responded to the petition by the National Democratic Party (NasDem) No. 192-05-16/PHPU.DPR-DPRD/XVII/2019. In the previous hearing on the election of DPR members from the electoral district (Dapil) of Banten 1, the NasDem Party (Petitioner) argued structured, systematic, and massive (TSM) violations carried out by legislative candidate from the United Development Party (PPP) Iip Miftahul Khoiri during the 2019 Legislative Election. “It has been handled by Bawaslu; the violations were not proven,” said the KPU’s attorney M. Ulin Nuha.

The KPU also responded to the Petitioner\'s alleged of vote inflation for the NasDem Party, the Prosperous Justice Party (PKS), the Indonesian Democratic Party of Struggle (PDIP), and the Golkar Party. This allegedly happened in 8 sub-districts in South Tangerang as a result of the election of DPR members in Dapil Banten 3. "We deny this proposition with the attached evidence," Ulin explained.

The KPU denied NasDem\'s allegation of ballot stuffing for PKS and vote purging for NasDem. This happened in 11 sub-districts as a result of the election of DPRD members Dapil South Tangerang. This argument was rejected by the KPU.

Next, the KPU through attorney Bagus Setiawan responded to the petition of the National Awakening Party (PKB) No. 27-01-16/PHPU.DPR-DPRD/XVII/2019, which questioned Dapil Banten 6. "The Respondent denies any and all statement, argument, claim, and petition of the a quo Petitioner, except for matters of which validity and truth are acknowledged in written, categorically, and specifically by the Respondent," said KPU’s attorney Bagus Setiawan.

The KPU confirmed that the vote margin argued by PKB in the election of Banten Provincial DPRD members in Dapil Banten 6 in Karang Tengah Sub-district was inaccurate. "[Based on] evidence T-003, T-004 and T-005," Bagus said.

Furthermore, KPU responded to the petition by the Democratic Party No. 54-14-16/PHPU.DPR-DPRD/XVII/2019 for Dapil South Tangerang 1. KPU dismissed the Petitioner’s argument about ballot stuffing in 26 sub-districts, 68 villages in Banten.

According to the KPU, the Petitioners did not mention votes at/in which polling stations (TPS) and villages had been inflated. The Respondent submitted evidence T-009 to support the rebuttal, which included DA, DA1, and DAA1 forms from 35 sub-districts in Banten Province. The KPU also has a video evidence (evidence T-010).
