JAKARTA, Public Relations of the Constitutional Court—-The Constitutional Court held a second hearing of the 2019 DPR-DPRD (House of Representatives-Regional Legislative Council) legislative election results dispute (PHPU) on Tuesday (16/7/2019). The KPU as the Respondent, the Related Party, and the Election Supervisory Agency (Bawaslu) were present to provide responses on the Petitioners\' arguments. The hearing was presided over by Constitutional Justice I Dewa Gede Palguna, with Constitutional Justices Suhartoyo and Wahiduddin Adams.
Previously, the Crescent Star Party (PBB) in case No. 98-19-26/PHPU.DPR-DPRD/XVII/2019 questioned the DPRD seats for Parigi Moutong Regency and North Morowali Regency, Central Sulawesi Province. In the electoral district (dapil) Parigi Moutong 1, PBB claimed to have received 3,292 votes, but the Respondent declared their vote at 1,963 votes.
In in Siniu Sub-district, PBB claimed that their votes were reduced by 106 votes. This also happened in Ampibabo Sub-district, where the Petitioner lost 380 votes. In addition, 390 votes had been purged in South Parigi Sub-district and 453 votes in Parigi Sub-district.
Meanwhile, in Dapil North Morowali 1, PBB claimed to have received 1,312 votes, but the Respondent declared 1,288 votes for PBB. PPB claimed 12 of their votes had been purged at TPS (polling station) 004 of Petasia Sub-district. Then, in several polling stations there were additional votes for the National Democratic Party (Nasdem) at TPS 005 of Bungintimbe Village, TPS 003 of Kolonade Village, and TPS 006 of Ganda-Ganda Village. Responding to this, the Respondent\'s attorney Imam Munandar stated that PBB\'s witness had never objected to the vote recapitulation. The KPU also questioned the reasons why PBB questioned their vote acquisition in Parigi Moutong Regency to the Constitutional Court.
"We also questioned the claim of votes obtained by the Petitioner because it was the vote results before a revote (PSU) was held at polling stations in Sausu Village, TPS 04 of Tolai Village, TPS 03 of Pinotu Village," he said firmly.
Related to the votes in North Morowali Regency, Imam emphasized that the arguments alleged by the Petitioner were not proven. "For example, at TPS 002 of Ganda-Ganda Village. The revote (PSU) had been held when it was proven that some voters voted by using family cards (KK). Then, [they] said, there was ballot box opening at TPS 005 of Bungintimbe Village and 11 additional votes to the candidate for the National Democratic Party (Nasdem) were not proven," he explained.
The Nasdem Party\'s attorney Abdul Rahman stated that the Petitioner\'s petition was baseless because the Petitioner could not prove their argument regarding their votes in North Morowali Regency. The same thing was argued by Ruslan Husen representing Bawaslu. He also emphasized that the Bawaslu did not find any vote reduction experienced by the Petitioner.
Meanwhile, the Indonesian Solidarity Party (PSI) with Case No. 204-11-25/PHPU.DPR-DPRD/XVII/2019 questioned vote acquisition in North Minahasa electoral district (dapil) 4 for DPRD seats of North Sulawesi Province. The Petitioner claimed that they received 1,372 votes in Kauditan District and the Democratic Party received 1,062 votes. The petitioner said that two voters using Papuan ID cards were given five ballot papers by the polling committee (PPS) of Treman Village. In addition, there were 6 additional anomalous votes. The inflated votes changed the results of the Democratic Party\'s vote acquisition in Kauditan Sub-district to 1,754 votes. There were also 3 additional votes for the Democratic Party in TPS 1 of Dapil Kauditan 2. Moreover, the Petitioner said their witnesses only received a copy of the C1 form at TPS 7. Similarly, during the plenary meeting at the sub-district, all witnesses were not given the DAA1 form. PSI requested that the Constitutional Court order the Respondent to hold a revote at TPS 1 in Treman Village, Kauditan Sub-district.
Dedy Mulyana as the Respondent\'s attorney stated that there was no correlation between two people having Papuan ID cards definitely voting for the Democratic Party. So, it couldn’t be concluded that their choices had harmed PSI\'s vote.
Dedy said a decree from the local Bawaslu stated that the North Minahasa Regency KPU did not directly make administrative errors, but the mistakes were done by the Polling Station Working Committee (KPPS). "The Petitioner\'s petition was also baseless because during the vote recapitulation, they never stated their objections and their witnesses always signed the minute," he explained.
Rony Eli Hutahaean as attorney of the Relevant Party said that the Petitioners\' petition was unclear because the posita did not correlate with the petitum. "We request that the Constitutional Court reject the Petitioner\'s petition in its entirety," he stated on behalf of the Democratic Party.
In the hearing, the Panel of Justices also heard cases from North Sulawesi and Central Sulawesi. The other cases from North Sulawesi were case No. 121-12-25/PHPU.DPR-DPRD/XVII/2019 for the National Mandate Party (PAN), No. 67-14-25/PHPU.DPR-DPRD/XVII/2019 for the Democratic Party, and No. 133-09-25/PHPU.DPR-DPRD/XVII/2019 for the United Indonesia Party (Perindo). In addition, the panel of justices also examined cases No. 163-02-25/PHPU.DPR-DPRD/XVII/2019 for the Great Movement Party (Gerindra), No. 81-03-25/PHPU.DPR-DPRD/XVII/2019 for Indonesian Democratic Party of Struggle (PDIP), and also No. 204-11-25/PHPU.DPR-DPRD/XVII/2019 for the Indonesian Solidarity Party (PSI).
Meanwhile, the cases from Central Sulawesi were No. 19-01-26/PHPU.DPR-DPRD/XVII/2019 for Syarif Hidayatullah as individual, No. 19-01-26/PHPU.DPR-DPRD/XVII/2019 for the National Awakening Party (PKB), No. 98-19-26/PHPU.DPR-DPRD/XVII/2019 for the Crescent Star Party (PBB), No. 86-03-26/PHPU.DPR-DPRD/XVII/2019 for the Indonesian Democratic Party of Struggle (PDI-P), and No. 147-02-26/PHPU.DPR-DPRD/XVII/2019 for the Great Movement Party (Gerindra).
