Perindo Questions Vote Reduction in Berau

JAKARTA, Public Relations of the Constitutional Court—The Indonesian Unity Party (Perindo) argued vote purging in Berau Regency of East Kalimantan Province (Kaltim). This was revealed in the 2019 DPR-DPRD (House of Representatives-Regional Legislative Council) legislative election results dispute (PHPU) hearing on Thursday (11/7/2019).

The hearing was held in Panel 3 Courtroom on the fourth floor of the Constitutional Court building. This panel was presided over by Constitutional Justice I Dewa Gede Palguna, with Constitutional Justices Suhartoyo and Wahiduddin Adams on the bench.

The Perindo Party (Petitioner) through attorney Yesaya Marcelino Tampubolon questioned the votes for the Berau Regency DPRD seat for Berau 4 electoral district (dapil). "We should have received 2,024 votes. However, the Respondent (KPU) determined only 1,883 votes," Marcelino said, conveying the subject of the petition No.140-09-23/PHPU.DPR-DPRD/XVII/2019 submitted by the Perindo Party.

Marcelino explained 141 votes for the Perindo Party has been purged through various methods. The General Elections Commission (KPU) as Respondent reduced the votes by declaring punched out ballot papers invalid ballots. "The reason was because four ballot papers came from another dapil. This happened at TPS [(polling station)] 1 of Muara Lesan," he explained.

Marcelino stated that potential voters for the Petitioner that were registered in the Additional Final Voters List (DPTb) couldn\'t use their right to vote because administrators had prioritized the voters in the Special Voters List (DPK) on polling day. Not only that, the Respondent did not provide ballot papers for the Berau Regency DPRD in several polling stations in Kelay Sub-district. "Even though the ballot papers for the DPR RI, DPD, Provincial DPRD, and the presidential and vice-presidential candidates are available," he said.

"We request that the Constitutional Court order a revote (PSU) at Long Beliu TPS 4, Merapun TPS 1, Merapun TPS 3, Merapun TPS 4, Merapun TPS 5, dan Muara Lesan TPS 1. In addition, we requested that the Constitutional Court declare the Petitioner\'s votes in the amount of 2,024 votes," he said when reading the petitum.

At the same hearing, the Constitutional Court also held examined case No. 118-12-23/PHPU.DPR-DPRD/XVII/2019 submitted by the National Mandate Party (PAN). The Petitioner’s attorney Zulkifli Akaf said that his camp questioned vote reduction for Samarinda Municipality DPRD seat of Samarinda Municipality 4 electoral district. "We should have had 5,279 votes, not 5,231 vote as determined by the Respondent," said Zulkifli.

PAN accused alleged the purged 48 votes had benefitted the National Awakening Party (PKB), and leading PKB to get one DPRD seat that should have been PAN\'s right. "PKB should have received 5,263 votes, but in the Respondent\'s version we only received 5,330 votes," said Zulkifli

He said that PKB inflated the votes by 67 votes in 9 polling stations in various villages, whereas PAN’s votes were reduced in 13 polling stations scattered in various villages, with a total of 48 votes.

"We requested that the Constitutional Court return the Petitioner’s votes have been purged, as many as 48 votes and decide that the Samarinda Municipality DPRD seat go to the Petitioner," said Zulkifli while reading the petitum.

The third session of panel 3 specifically held a DPR-DPRD PHPU hearing for East Kalimantan Province. Several cases were examined in Panel 3:  No. 182-04-23/PHPU.DPR-DPRD/XVII/201 submitted by Golongan Berkarya Party (Golkar), No. 182-04-23/PHPU.DPR-DPRD/XVII/2019 submitted by individual M. Yunan Kadir, No. 218-07-23/PHPU.DPR-DPRD/XVII/2019 submitted by Berkarya Party, and No. 64-14-23/PHPU.DPR-DPRD/XVII/2019 submitted by the Democratic Party.

The Petitioners and their attorneys attended the hearing except the Berkarya Party. At the end of the session, the panel of justices announced that the next hearing would be held on Monday, July 15, 2019 at 08.00 WIB. (Arif Satriantoro/NRA/RD)
