JAKARTA, Public Relations of the Constitutional Court—The United Development Party (PPP) questioned the insufficient of ballot papers in Padang Pariaman Regency. This was revealed in the 2019 DPR-DPRD (House of Representatives-Regional Legislative Council) legislative election results dispute (PHPU) hearing for West Sumatra Province on Thursday (11/07/2019).
Angga Brata Rosihan as the PPP’s attorney questioned the votes for the DPRD seat of West Sumatra Province for West Sumatra 2 electoral district (dapil). "We should have received 16,920 [votes] for allocation in West Sumatra Provincial DPRD seat. However, the Respondent declared our votes at 16,856," he said on the case No 104-10-03/PHPU.DPR-DPRD/XVII/2019.
The insufficient ballot papers, Angga said, occurred at TPS (polling station) 03 of Kampuang Parik. PPP argued that 102 people could not use their voting rights, even though they were registered in the final voters list (DPT). Eight people who could not vote were even election administrators.
Responding to this, Angga added that the TPS Election Supervisory Committee had provided recommendations and reported it to the District Supervisor (Panwascam) for a revote there. However, he added, this recommendation was also not implemented by the Respondent. "This caused 102 people to lose their voting rights. Five [of those] people planned to cast a vote for the Petitioner," he explained.
For this reason, in his petitum, the Petitioner requested that the panel of justices order a revote (PSU) at Kampuang Parik TPS 03 and also determine the allocation of seats in the Provincial DPRD based on the results of the revote.
Regarding the petition, Constitutional Justice I Dewa Gede Palguna as chairman of panel 3 requested that the Petitioner revise the legal standing because there was a mistake in writing the KPU\'s decree number. "In the [document], the KPU\'s decree is Number 58 but it is written as number 59 in the petition," he explained.
In the same session, case No. 125-12-03/PHPU.DPR-DPRD/XVII/2019 submitted by the National Mandate Party (PAN) was also examined. Shanti Dewi as PAN\'s attorney acted on behalf of the party and questioned the votes for the Agam Regency 4 electoral district (Dapil) concerning the seat for candidate Rifky Syaiful .
Shanti said that PAN should get 8,914 votes but the Respondent actually declared their votes at 8,887. "PPP benefitted, as its votes changed from 2,964 votes to 2,966 votes," he said.
The vote discrepancy occurred because votes for PAN in various places were purged, such as at TPS 1 and TPS 15 of Baso Sub-district and TPS 12 of Angke Sub-district, said Shanti. PPP’s votes at TPS 1 of Baso Sub-district were inflated. "Twelve votes for PAN in TPS 19 of Angkek Ampek Sub-district were also not recognized," she said.
In the petitum, the Petitioner requested that the panel of justices declare 8,914 votes for PAN and 2,966 votes for PPP. He also requested that the panel of justices declare Rifky Syaiful eligible for a seat at the Agam Regency DPRD with 2,971 votes.
In the same session, the case No. 196-05-03/PHPU.DPR-DPRD/XVII/2019 for the National Democratic Party (Nasdem) was examined. However, Ibrani as the attorney withdrew the petition. The panel also examined case No. 232-07-03/PHPU.DPR-DPRD/XVII/2019 for the Beringin Karya (Berkarya) Party. However, they did not attend the hearing. Justice Palguna said that the Court would take an action in the next hearing.
The panel also examined cases No. 125-12-03/PHPU.DPR-DPRD/XVII/2019 filed by Mardison Basir as an individual, No. 73-03-03/PHPU.DPR-DPRD/XVII/2019 for the Indonesian Democratic Party of Struggle (PDIP), and No. 51-14-03/PHPU.DPR-DPRD/XVII/2019 for the Democratic Party.
At the end of the hearing, Justice Palguna explained the next session would be held on Wednesday, July 17, 2019 at 08.00 WIB to hear the Respondent’s response and the statements of the Relevant Party and Bawaslu. (Arif Satriantoro/LA/RD)
