Democratic Party Internal Dispute, KPU Ignores Bawaslu

JAKARTA, Public Relations of the Constitutional Court—Deputy Chief Justice of the Constitutional Court (MK) Aswanto with Constitutional Justices Saldi Isra and Manahan M. P. Sitompul in Panel 2 held the hearing of the 2019 DPR-DPRD (House of Representatives-Regional Legislative Council) Legislative Election Results Dispute (PHPU) on Wednesday (10/07/2019) at 19:00 WIB at the Panel Courtroom of the Constitutional Court on the fourth floor. The preliminary hearing of the DPR-DPRD PHPU on Lampung Province examined petitions submitted by several political parties.

In petition No. 149-02-09/PHPU.DPR-DPRD/XVII/2019 by the Great Movement Party (Gerindra), attorney Hendarsam Marantoko said that many voters could not vote in the 2019 General Elections in Lampung Province because they did not receive the invitation to vote.

“Besides that, there were miscalculations in seven regencies and municipalities, which decreased the votes for the Gerindra Party. Another result of the miscalculations is the increase of the votes for the Golkar Party, PDIP, and PAN," Hendarsam explained.

Miscalculation also occurred on Tanggamus Regency DPRD members. As a result of the miscalculation, votes were switched to PDIP from Gerindra Party.

"These problems have been reported to Bawaslu, which recommended that the KPU compare data. However, the recommendation have not been implemented," Hendarsam said.

Hendarsam also said that there was a dispute about votes between the Gerindra Party candidates for the Lampung DPRD. The Gerindra Party questioned the votes for candidate Roy Suryo, some of which had allegedly been switched to another Gerindra candidate, Dafrian Anggara.

Furthermore, the panel of justices examined the petition of the Democratic Party No. 48-14-09/PHPU.DPR-DPRD/XVII/2019. The petition concerns Democratic Party candidate Yandri Nazir in East Lampung electoral district (Dapil) 8.

“There was a dispute over the election results for the seats of the Lampung Province DPRD members between Yandri Nazir and another Democratic candidate Asep Makmur. Our client was harmed by the vote inflation by the KPU, so Asep Makmur\'s vote increased. Therefore, we have reported the problem to Bawaslu [the Election Supervisory Body], which recommended a revote. However, Bawaslu’s recommendation was not implemented by the KPU," said Yandri Nazir attorney’s Yandri Sudarso. (Nano Tresna Arfana/NRA)
