JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) held a hearing on the DPR-DPRD Legislative Election Results Dispute (PHPU) of Papua Province on Tuesday (09/07/2019). The preliminary examination was carried out by three panels by constitutional justices. Each panel consists of three constitutional justices. Panel 1 was presided over by Chief Justice Anwar Usman (Chairperson) with two panel members, Justices Enny Nurbaningsih and Arief Hidayat. Panel 2 consists was presided over by Justice Aswanto (Chairperson) with two panel members, Justices Saldi Isra and Manahan MP Sitompul. Panel 3 was presided over by Justice I Dewa Gede Palguna (Chairperson) with two panel members, Justices Suhartoyo and Wahiduddin Adams.

Panel 2 examined the 2019 DPR-DPRD PHPU in the Electoral District (Dapil) of the Papua Province. The Chairperson of Panel 2 Justice Aswanto opened the first session at 08.01 WIB.

Cases submitted by six political parties in the Electoral District (Dapil) of the Papua Province were examined by the constitutional justices in Panel 2 in the first session. They are cases Number 207-07-33/PHPU.DPR-DPRD/XVII/2019 of DPR-DPRD PHPU of Papua Province petitioned by the Berkarya Party; Number 11-08-33/PHPU.DPR-DPRD/XVII/2019 of DPR-DPRD PHPU of Papua Province petitioned by the Prosperous Justice Party (PKS); Number 144-20-33/PHPU.DPR-DPRD/XVII/2019 of DPR-DPRD PHPU of Papua Province petitioned by the Indonesian Justice and Unity Party (PKPI); Number 161-02-33/PHPU.DPR-DPRD/XVII/2019 of DPR-DPRD PHPU of Papua Province petitioned by the Great Movement Party (Gerindra); Number 83-03-33/PHPU.DPR-DPRD/XVII/2019 of DPR-DPRD PHPU of Papua Province petitioned by the Indonesian Democratic Party of Struggle (PDIP); and Number 96-19-33/PHPU.DPR-DPRD/XVII/2019 of DPR-DPRD PHPU of Papua Province petitioned by the Crescent Star Party (PBB).

PDIP through attorney Imran Mahfudi revealed vote purging in several regencies in the Papua Province. As many as 22,472 PDIP votes in Pegunungan Bintang District were reduced, in Nabire District 71,226 votes, in Dogiyai District 50,517 votes, in Intan Jaya District 45,067 votes, in Tolikara District 23,274 votes, and in Yahukimo District 42,067 votes. PDIP\'s total votes were decreased by 250,426 votes.

On the other hand, votes for other political parties were allegedly inflated. "For example, the National Awakening Party (PKB) had an increase to 117,060 votes, the Nasdem Party to 48,503 votes, and the National Mandate Party to 33,749 votes," said Imran before the Panel 2 Court, presided over by Justice Aswanto with Constitutional Justices Saldi Isra and Manahan M. P. Sitompul.

PBB through attorney Yasin also questioned vote purging. “There has been a reduction 40,527 votes as evidenced in P-7 and P-8. The votes were switched to several other political parties, PKB, Berkarya, PAN, and Nasdem," Yasin said.

According to Yasin, the switch of votes was discovered in a video recording of the recapitulation plenary meeting. Meanwhile, in Election District (Dapil) Tolikara 2, 3,468 votes for PBB had been purged in Wina District.

On the other hand, the Berkarya Party’s attorney Abdul Lukman Hakim revealed that 372 votes had been purged in the South Jayapura District.

PKS through attorney Fauzan Muslim revealed a reduction of 2,518 PKS votes in Amungkalpia District, Puncak Regency. According to Fauzan, the PKS vote acquisition should be 3,982 votes.

PKPI questioned ballot stuffing. PKPI suspects a violation that made it lose 800 votes from the supposed 3,350 votes. In Jayapura Dapil 3, no DAA 1 forms in the village were submitted to the political parties. This was proven as no witnesses signed the forms, and plenary meeting at the PPK (Sub-district Election Committee) level were never finished, indicating ballot stuffing.

Finally, the Gerindra Party questioned inaccurate input of data. As a result, 30,011 Gerindra votes had been purged in Jayawijaya Regency, Lani Jaya Regency, and Asmat Regency. (Nano Tresna Arfana/NRA)
