Chief Justice: Insha Allah Everything Safe Post-Ruling

JAKARTA, Public Relations of the Constitutional Court—Chief Constitutional Justice Anwar Usman hoped that security post-ruling of the 2019 presidential and vice presidential election results dispute (PHPU) case would be controlled. “Insha Allah the situations will be safe and controlled post-ruling,” he said in the presence of Secretary General M. Guntur Hamzah, Greater Jakarta Metropolitan Regional Police Chief (Kapolda Metro Jaya) Gatot Eddy Pramono, Jakarta military commander (Pangdam Jaya) Eko Margiyono, and several Constitutional Court officials at the 11th floor of the Constitutional Court building on Tuesday (11/6/2019).

Justice Anwar said that security is dependent on all stakeholders, thus coordination is needed among the Court, the Elections Supervisory Agency (Bawaslu), the General Elections Commission (KPU), the Indonesian Military (TNI), and the Police. He hoped that the ruling of the presidential and vice presidential (PHPU) case would finish before Friday prayer on June 28. “As a matter of fact, [it would be great] if the Pilpres results dispute case settlement finish in just one week,” he added.

Gatot has coordinated with the Constitutional Court so that all audience of the presidential (PHPU) hearing would enter from the back door on Abdul Muis Street. In addition, an LED display will be placed at several ministries surrounding the Constitutional Court to monitor security during the proceedings.

Preliminary Hearing

Registration of cases in the constitutional case registration book (BRPK) is scheduled for Tuesday to Thursday (11-13/6/2019). Court spokesperson Fajar Laksono in a press conference said that the result of BRPK and litigants of the 2019 presidential and vice presidential PHPU petition would be informed through e-mails, which they had provided when submitting the petition. He added that the scheduled preliminary hearing would take place on Friday, June 14.

“The hearing has a sole agenda, that is, to hear the subjects of the petition file by the Petitioner. The Constitutional Court invited litigants—the KPU as Respondent, the Presidential and Vice Presidential Candidates No. 1 or their attorneys as Relevant Party, as well as the Elections Supervisory Agency,” Fajar said at the ground floor lobby of the Constitutional Court.

Responding to the question about the submission of petition revision document during BRPK registration, Fajar stressed that the Court’s Registrar Office only offer technical services, as the petition revision mechanism is not regulated in the Constitutional Court Regulation (PMK). “So, if the Petitioner wishes for a revision, the Registrar does not have the right to reject it, and only the justices have the authority to pass legal judgment to the Petitioner’s petition document,” he explained.
