Four Parties Complete 2019 Legislative PHPU Document

Four political parties completed the document for the 2019 legislative election results dispute (PHPU) petition on Thursday afternoon (30/5/2019). They are the National Awakening Party (PKB), the Prosperous Justice Party (PKS), the Golongan Karya Party, and the National Mandate Party (PAN).

PKB arrived at around 17.00 WIB. The party completed the documents for the Provinces of Jambi, East Java, West Java, Papua, West Papua, North Sumatera, Maluku, North Maluku, and Southeast Sulawesi.

PKB’s attorney Syamsul Huda Yudha said that they completed the document for the vote dispute for the House (DPR) seat in the petition of East Java Province. They also completed the document for the vote dispute for Bangkalan and Malang Districts.

“[The petition documents] for other regions are still incomplete only in terms of administrative matters, for example needing more copies of the petitions. The major requirements are completed,” Syamsul said. He revealed that PKB had filed 28 petitions, both by individuals or by the party, to the Constitutional Court. “We planned on completing all documents today,” he added.

Prior to PKB, PKS arrived at the Court at around 14.00 WIB. They completed the documents for the Provinces of West Java, South Kalimantan, Gorontalo, East Kalimantan, Lampung, and South Sulawesi. PKS’ attorney Basrizal said that they added two additional pieces of evidence for electoral district (Dapil) 7 of West Java. They revised the list of witnesses and list of evidence for Indramayu District, as well as re-arranging the petition for ease of examination. For Gorontalo Province, PKS added the original copy of power of attorney. “We do this after receiving the Incomplete Petition Certificate (APBL) from the Court,” he explained.

He said that all lawyers for PKS had been directly appointed by the PKS’ Central Executive Board (DPP). All petitions for the candidates from PKS were filed on behalf of the party, not the individuals. “Each of us was tasked with certain regions,” he said.

Golkar also completed their document on the same day at around 14.00 WIB. They completed the petition for Dapil Batam 1 DPRD (Regional Legislative Council). Attorney M. Sattu Pali said that they also added the letter of approval from the party’s chairperson and secretary general.

On the same day, PAN also completed the document for the petition of South Sumatera. Attorney Novriansyah also added a letter of approval from PAN DPP.

Papua DPD

The Court also received additional document for the Regional Representatives Council (DPD) PHPU petition of Hasbi Suaib from Papua Province. His attorney, Arsi Divinubun, arrived at the Court arrived at around 17.00 WIB, almost at the same time as the PKB team.

Arsi Divinubun said that his team added video recording showing that voting had not been executed in Tolikara, as well as a letter of recommendation from the Elections Supervisory Agency (Bawaslu). “We also made the petition into four copies [and] added a power of attorney,” he explained. He said that Hasbi Suaib received the fourth most votes, but as no voting took place in regions such as Tolikara, he did not earn a DPD seat. “In the petition we requested a revote in 29 districts/municipalities in Papua,” he said.

Petitioners have three days, from May 28-30, to complete the petition document. Thursday, May 30, 2019 at 24.00 WIB is the deadline for completing the document. So far, the Constitutional Court has received 327 petitions for DPR and DPRD PHPU, 10 petitions for DPD PHPU, and 1 presidential PHPU petition. (Arif S/NRA/Yuniar Widiastuti)
