Prabowo-Sandi Take Constitutional Route through Constitutional Court

The president-vice president candidate pair Prabowo Subianto and Sandiaga Salahuddin Uno (Prabowo-Sandi) filed a presidential election results dispute (PHPU) petition to the Constitutional Court on Friday evening (24/5/2019). Both Prabowo and Sandi did not attend. The petition of candidate pair number 2 was filed by the National Victory Agency (BPN) legal team representative, led by Bambang Widjojanto.

The team arrived at around 22.45 WIB, with Prabowo’s brother Hashim Djojohadikusumo, Gadjah Mada University (UGM) state administrative law expert Denny Indrayana, and University of Indonesia (UI) criminal law expert Teuku Nasrullah in attendance. Upon arriving, the BPN legal team was welcomed by Constitutional Court Registrar Muhidin, who symbolically received the petition.

Muhidin then explained to the team the requirements for the presidential PHPU petition. “I would like to remind [you] that the petition must be made twelve copies. This is the requirement for the petition,” he said. Similarly, the power of attorney and the list of 51 pieces of evidence must be made twelve copies. After the document is declared complete, the petition will be registered on June 11, 2019. Since that date, the Court is given 14 workdays to decide on the case.

Muhidin then elaborated on the proceedings of the presidential PHPU case. The preliminary examination hearing will be held on June 14, 2019. The next will be on June 17-21 to discuss the substance and subject of the petition. Last, the ruling hearing will be held on June 28. Any information, he added, will be sent through e-mail, so the Petitioner must include their e-mail address.

During a press conference, Bambang Widjojanto talked about structured, systematic, and massive violations that his candidate pair faced. He hoped that the Court would not only look at quantity, but the substance of the case. In the Q&A session, Bambang was reluctant to divulge the contents of the petition.
