JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court held the judicial review hearing of Law No. 21 of 2011 on Financial Services Authority (OJK Law) in the Plenary Courtroom of the Constitutional Court on Tuesday (19/3/2019). However, Head of the Legal Aid Bureau of the Ministry of Finance (MoF) Tio Serepina Siahaan said that the Expert for the Government requested a delay of statement for the case No. 102/PUU-XVI/2018.

"After coordinating with the expert, we would like to ask for a delay in delivering statement," explained Tio on the case petitioned by lecturers Yovita Arie Mangesti, Hervina Puspitosari, Sura Pria Priambada, and Ashinta Sekar Bidari. 

Chief Justice of the Constitutional Court Anwar Usman, who presided over the hearing in the presence of the other eight constitutional justices, said that the hearing was postponed until Monday, April 1, 2019 at 11.00 WIB to hear the statement of the Expert for the Government. 

The Petitioners had argued that their constitutional rights had been or were potentially violated by the enactment of Article 1 number 1 and Article 9 letter c of the OJK Law, especially along the word “investigation.” According to them, the investigative authority in Article 49 paragraph (3) of the OJK Law was not linked to the Criminal Procedure Code (KUHAP). The article states that when necessary, the OJK PPNS are authorized to carry out investigations without coordinating or asking for help from other law enforcers, namely police investigators. The Petitioners stressed that, observing the authority of the OJK investigators as stipulated in Article 49 paragraph (3) of the OJK Law, some norms violate the principle of due process of law and can lead to arbitrariness by OJK investigators.
