Students of Sukabumi STKIP PGRI Visit Constitutional Court

JAKARTA, Public Relations of the Constitutional Court—Students of the Indonesian Teachers Association’s Teacher Training College (STKIP PGRI)visited the Constitutional Court on Thursday morning (31/1/2019). The visit was part of the Pancasila and Civic Education (PKn) program of the PKn and Economy-Accounting Study Programs.

Constitutional Court junior researcher Winda Wijayanti welcomed the students and talked about “The Constitutional Court and within the Frame of the Unitary State of the Republic of Indonesia.” The idea of the constitutional court was proposed by Hans Kelsen, who saw the need for a body that reviews the constitutionality of laws.  In Indonesia, Muhammad Yamin suggested the idea, but Soepomo rejected it because the Indonesian laws had not discussed the idea of trias politica and there had not been sufficient law scholars.

Winda also explained that the Constitutional Court of Indonesia was established on August 13, 2003 post-Reform, based on the Third Amendment to the 1945 Constitution. The Constitutional Court has four authorities and one obligation of the Court granted by the 1945 Constitution. The authorities are the judicial review of laws against the 1945 Constitution, the resolution of interagency authority dispute, the resolution of legislative and presidential election result dispute, and the dissolution of political parties. One obligation granted to the Court is deciding on the House’s opinion of alleged violation committed by the president and/or vice president. (Lulu Anjarsari/Yuniar Widiastuti)
