Minister of Women\\'s Empowerment and Child Protection (Menpppa) Yohana Yambise met with Chief Justice of the Constitutional Court (MK) Anwar Usman on Wednesday (26/12) at the Constitutional Court. The meeting, which was also attended by Constitutional Justices Suhartoyo and Saldi Isra, was to obtain further information regarding the Constitutional Court Decision No. 22/PUU-XVI/2018 concerning the judicial review of the Marriage Law, which cancels the marriageable age limit of women at 16 years old.
On that occasion, Yohana appreciated the Constitutional Court Decision that canceled the enactment of Article 7 paragraph (1) of the Marriage Law. For her, it was a gift on the Mother\\'s Day, which is commemorated every December 22. "I expressed my appreciation for the Constitutional Court\\'s decision a while ago, because this is a Mother\\'s Day gift, and a gift for Indonesian children," she said.
Yohana said that she would approach the House of Representatives (DPR) and the president to find an agreement regarding the marriageable age limit. "After the New Year, I will immediately follow up," she said.
On December 13, 2018 the Constitutional Court canceled the enactment of the marriageable age limit of women at 16 years old as stipulated in Article 7 paragraph (1) of Law No. 1/1974 concerning Marriage (Marriage Law). This was confirmed by the Constitutional Court in Decision No. 22/PUU-XVI/2018 that was petitioned by three women who had got married as minors. In this decision, the Court granted the petition in part. The ruling states that Article 7 paragraph (1) along the phrase "aged 16 (sixteen) years" in Law No. 1/1974 concerning Marriage is contrary to the 1945 Constitution of the Republic of Indonesia and has no binding legal force.
In addition, the Court stated that the provisions of Article 7 paragraph (1) of Law No. 1/1974 concerning Marriage were still valid until changes were made in accordance with the grace period specified in the decision. In addition, the Constitutional Court ordered the legislators to make changes to Law No. 1/1974 concerning Marriage in a period of maximum 3 (three) years, especially regarding the minimum marriageable age for women.
