Govt Unprepared, Hearing of Criminal Procedure Code Postponed

The Constitutional Court (MK) once again held a hearing of the petition filed by Century Bank convict Robert Tantular. The petition No. 84/PUU-XVI/2018 examines the constitutionality of Law No. 8/1981 on the Criminal Procedure Code (KUHAP) and Law No. 1/1946 on the Criminal Code (KUHP). The hearing held by the Constitutional Court (MK) on Wednesday (14/11) afternoon, was scheduled for the statement of the Government but the Government was unprepared. 

"There are a number of things we would like to say before, Your Honor. With all due respect, we, the Government, requested to postpone the reading of the President\'s Statement for some reason. And a letter of has been submitted," said Government Representative Surdiyanto. The Relevant Parties, namely the Supreme Court, the Attorney General\'s Office, and the National Police said they were not ready to read their statement. 

The Petitioner had previously requested formal and material review of Article 272 of the Criminal Procedure Code (KUHAP) and Articles 12 and 65 of the Criminal Code (KUHP) that were deemed detrimental. The formulation of the norm in the a quo articles do not reflect a sense of legal justice and expediency because the enactment had caused the Petitioner to serve a criminal sentence exceeding the regulation. Therefore, the he requested that the Court revoke the enactment of the articles.
