The Constitutional Court once again held the Sampang District election dispute hearing on Tuesday (13/11). The hearing led by Chief Justice of the Constitutional Court Anwar Usman was to hear the report of re-election held all across Sampang District.

The Constitutional Court (MK) had previously ordered the General Elections Commission (KPU) of Sampang District to hold a re-election of Sampang Regent and Vice Regent in Decision No. 38/PHP.BUP-XVI/2018 read by Chief Justice of the Constitutional Court Anwar Usman in the presence of the other constitutional justices on Thursday (5/9). In the legal considerations read by Constitutional Justice Suhartoyo, the Court had found inaccuracies and invalid DP4 data used by the Sampang District KPU as Respondent in determining the DPT (final voters list) of the district election.

Miftahul Rozak, representing the Sampang District KPU, stated that Candidate Pair 1 received 307,126 votes, Candidate Pair 2 received 245,768 votes, and Candidate Pair 3 received 24,786 votes. "Meanwhile, the invalid votes reached 9,177. The total number of votes is 586,817," he explained in the hearing chaired by Chief Justice Anwar Usman.

Responding to the results of the re-election, the Candidate Pair Hermanto Subaidi-Suparto, represented by M. Sholeh, criticized several things, especially the DPT (final voters list). The Petitioners questioned the Sampang District KPU that still used the synchronization method that had been considered invalid, illogical, and had been canceled by the Constitutional Court.

"First, about the DPT. Since the beginning, the Team of Candidate Pair 2 questioned the method used by the KPU fellows to synchronize the DPT that had been considered invalid, illogical, and canceled by the Court, which was still used to synchronize the DP4 and the DPT 803," he explained.

Sholeh added, when the DPT was rejected, the re-election was not supposed to be held. However, for the sake of the proper implementation of the re-election, his clients still gave their signatures. However, they had requested consultation with the Constitutional Court, which had not been done.

Next, the Petitioner questioned the C6 model form. The Petitioners had previously requested that the C6 model form be properly or evenly distributed. However, in vulnerable places the opposite had occurred. "Our witnesses were not allowed to enter during the first opening at 7:00 a.m. and there is evidence, which we included," he said.

Finally, they also questioned setong, the calculation method that is not in accordance with the PKPU. "We have video evidence that it still occurred. We received information that all East Java district/municipal Bawaslu Commissioners were present in all polling stations. However, this [incident] was ignored," he said.

Meanwhile, the Sampang District Election Supervisory Body (Bawaslu) representative Insyiatun conveyed that there were indications of violation occurring in the Districts of Ketapang, Kedungdung, Torjun, and Camplong. The violation is that the C6 model forms were not submitted to the voters based on the report by Candidate Pair Number 2.

In addition, said Insiyatun, at TPS 5 in Kemuning Village, Sampang Sub-district there was a margin between the ballots and the C7 model forms. The ballots used were 297 sheets, while the C7 voters form were 294 sheets.

Finally, Insyiatun said there were multiple voters at TPS 7 in Nepa Village, Banyuates Sub-district. "We found voter by the name of Kholil who voted in 2 polling stations, namely TPS 6 and TPS 8 in Nepa Village, Banyuates Sub-district.
